Slovakia's parliament has approved a constitutional amendment that clearly defines that there are only two genders, male and female, putting the country in direct conflict with prevailing European Union norms.
Of the 99 lawmakers present, 90 voted in favor of the proposal, the TASR news agency reported on Friday. The decision raises major tensions between Bratislava and Brussels, as the EU recognizes gender identity and protects the rights of the LGBTQ community.
The amendment challenges the EU principle that European law takes precedence over national laws, opening the way for a potential legal conflict. The changes approved are not limited to the definition of gender, but also include restricting adoption rights to married couples, banning surrogacy and requiring equal pay for men and women.
All of these provisions are expected to come into force on November 1. Prime Minister Robert Fico has described the reform as a defense against Brussels’ “progressive ideology” and an expression of national sovereignty. The Slovak National Party coalition said the vote proves that “reason, values and principles can prevail within the European Union,” according to TASR reports.
On the other hand, critics have warned that the amendment constitutes a dangerous retreat from human rights and could violate international law, leaving transgender, intersex and non-binary people legally unprotected.
This decision comes a few months after a similar measure in Hungary, where in April the parliament decided gender is strictly based on sex at birth and prioritized children's right to physical, mental and moral development over other rights.
