The Bosnia and Herzegovina (BiH) Prosecutor's Office announced today that it will not open an investigation against the leader of the Alliance of Independent Social Democrats (SNSD), Milorad Dodik, for genocide denial.
Denial of genocide in Bosnia and Herzegovina is punishable by six months to five years in prison. Sarajevo media reports that many participants in the meeting of the then ruling coalition (Troika, SNSD, HDZ) in the summer of 2023 in Konjic stated that Dodik had denied the genocide at the time, and a few months later Jasmin Duvnjak, president of the Bosniak People's Club in the House of Peoples of the Parliament of the Federation of BiH, filed criminal charges against him for this.
According to the prosecution, Duvnjak submitted media articles along with the report in which, among others, BiH Defense Minister Zukan Helez and Milorad Dodik spoke about condemning genocide.
The prosecution stated that members of the BiH Investigation and Protection Agency (SIPA) received a statement from Helezi, in which he stated that Dodik denied the genocide at an inter-party meeting in Konjic.
Duvnjak, who filed a criminal complaint against Dodik, was also questioned by SIPA.
The BiH Prosecutor's Office announced that it will not launch an investigation because the report and accompanying documents show that no criminal offense was committed and that there is no evidence that Dodik may have incited violence with his statement, as defined by the BiH Criminal Code.
