
The US Supreme Court on Monday threw out a lawsuit seeking to disqualify Donald Trump from the 2024 election, under a constitutional provision that bars anyone who "engages in rebellion or revolution" from holding public office.
The justices dismissed the appeal of John Anthony Castro, a tax consultant from Texas. Castro had appealed a lower court ruling that said he could not file a lawsuit seeking Trump's impeachment under the 14th Amendment to the US Constitution.
This may not be the last time the Supreme Court is asked to rule on this issue. Other lawsuits involving the 14th Amendment and Trump are still pending in lower courts.
The 14th Amendment states that "No person shall become a senator or representative in Congress, or an elector for president and vice president, or hold any office, public or military, in the United States or in any state, who, having previously sworn to the Constitution of the United States, engaged in rebellion, or afforded aid or asylum to the enemies of the state."
Trump, the front-runner for the Republican nomination, has continued to make the false claim that the 2020 election was stolen from him through fraud.
Other legal efforts to impeach Trump under the 14th Amendment are underway, including a lawsuit filed Sept. 6 by the nonpartisan group Citizens for Accountability and Ethics in Washington.
