Agricultural lands without title, but in use by third parties, will pass through the sieve of the inter-institutional Task Force proposed by the Council of Ministers.
The decision published in the Official Gazette "On the establishment of the Task Force for the coordination of the process of handling agricultural lands in use, under the terms of Article 12, of Law no. 20/2020" provides that the Task Force will have representatives from the State Cadastre Agency, the Ministry of Agriculture and Rural Development, the Ministry of Finance and Economy, the Ministry of Justice, the Property Management Agency and the State Authority for Geospatial Information . Its composition will be approved by order of the Prime Minister.
The Task Force will have the task of drawing up the action plan for handling and solving the problem related to agricultural lands in use by natural persons (individuals) without title. First, the surfaces of the properties and their owners will be recorded.
Further, the Task Force will analyze case by case the circumstances for acquiring ownership according to the original ways provided in the Civil Code or other special ways, provided in separate laws.
On the other hand, according to the decision, the Task Force will cooperate with the State Cadastre Agency, in order to finalize the processes, for the requests submitted to this institution by the local government.
The deadline for the identification of the surfaces of agricultural properties without such ownership, but in use by others and addressing the resolution of the ownership problem has been determined 1 year from the entry into force of the decision.
The object of the Task Force's activity will be immovable assets that meet certain conditions, such as: they have been abandoned by the legal claimant and have not been registered with the State Cadastre Agency (ASHK), they are agricultural land (according to its relevant entries), they are not the private property of third parties, they are not subject to forms of physical compensation, they are not occupied by constructions without permission of third parties or of the requesting entity itself, they are not the subject of strategic investments, according to the legislation in force on strategic investments, they are not property State properties intended for tourist purposes, are not inalienable public property and are not occupied by constructions, object of treatment, of article 34, of law no. 20/2020, "On the completion of transitional ownership processes in the Republic of Albania".
The decision determines that in support of the activity of the Task Force, its technical secretariat will be formed at the State Cadastre Agency, composed of employees of this Agency. Secretariat employees are appointed by the general director of ASHK./ monitor
