Now that the public consultation on the Criminal Code is starting, there will be many suggestions for its various articles. I have neither a legal education nor any legal experience. But I have a long scientific experience in the statistical-economic analysis of unnatural injuries/deaths.
I have published 63 scientific articles in the US about unnatural injuries/deaths. Three-quarters of them have been about road injuries/deaths. The road conditions and traffic codes there are different from those in Albania, but some valuable lessons can be drawn from the studies I have conducted.
In the US, about 21% of road deaths are among pedestrians/bicyclists. In the first 8 months of this year, 48 pedestrians and 6 cyclists lost their lives in Albania, which accounts for almost 40% of road deaths. In the same period a year ago, 47 pedestrians and 8 cyclists lost their lives in Albania, which accounts for 55% of road deaths. Such percentages are found only in some African or Southeast Asian countries…
In Albania, such cases are classified as 'accidents resulting in death'. In the vast majority of the 50 states of the USA, such cases are classified as road homicide, when the driver of the vehicle has driven it irresponsibly!
Endless statistical studies have shown that when drivers significantly exceed the speed limit, overtake in the wrong way, drive under the influence of alcohol or talk on a cell phone, they can kill pedestrians, cyclists or motorists. That is why road deaths caused by irresponsible driving, in the vast majority of the 50 states of the United States, are classified as road homicides, not accidental deaths.
If drivers drive responsibly, the deaths of pedestrians/cyclists/motorcyclists/motorists who drive the wrong way can be avoided. While irresponsible driving can result in road homicide, which should be punished with imprisonment!
