SPAK requests 32 years in prison for Duka, Santiago Malko's mother: To be sentenced to death

Today, the trial of Leonard Duka took place at the Special Court, for whom SPAK has requested a sentence of 32 years in prison, for organizing and murdering former police officer Santiago Malko.

In total, SPAK has requested 157 years in prison for the members of Leonard Duka's group. More specifically, SPAK has requested 32 years in prison for Leonard Duka, 25 years for Erlis Duka, 32 years in prison for Fatmir Hyseni, 22 years in prison for Aleksandër Manjhaku, 23 years in prison for Oltian Loga and 23 years in prison for Dritan Agajn.

Meanwhile, Santiago Malko's mother was present at the court session today, requesting the death penalty for Leonard Duka.

Malko's mother expressed her full conviction that Leonard Duka had killed her son, even, according to her, in complete disloyalty.

On the other hand, Leonard Duka has insisted that he is innocent in this story, adding that everything against him is fabricated by the Police to ruin his image.

Meanwhile, on January 21, at 11:45, the GJKKO decision on this matter will be issued.

Excerpts from the debates at the GJKKO:

Santiago Malko's mother: to be sentenced to death

Lawyer Melina Gjeta: SPAK's conclusions are not based on evidence and law. There is no evidence, but only deductions created by an incomplete and biased investigative process, mostly based on stories reported in the media. Witness Blendi Teta has stated before the court that he was threatened and put under pressure by the State Police and Ervis Martini, and these are serious violations of the law. The testimony does not serve the truth, but the fabrication of evidence. Teta's testimony, which he claims in court that he gave it under pressure from Ervis Martini, cannot be used by the prosecutor in the final conclusions. Blendi Teta's testimony is also confirmed by that of Ilir Selmani, the other co-defendant, making them credible. Selmani has also said before this court that 500 thousand euros were given to sink the Duka brothers.

The prosecution says that the murder was motivated by revenge for two injuries allegedly committed by the victim Santiago Malko, but those events are still unsolved and investigators have suspended proceedings because they have not found the perpetrators. How can the prosecutor determine the perpetrator of those events, while the competent persons who investigated them have not identified them? The Sky transcripts are not legal evidence and the results derived from them are illegal under Albanian law. They violate the freedom and confidentiality of correspondence. The interception by the French authorities constitutes mass interception, it was not targeted. The identification made by the OPJ of the codes was amateurish and unreliable, as standard procedures were not followed. Leonard Duka himself stated before the court that he did not use the Sky application.

Leonard Duka: I declare that I am innocent and the prosecutor has no facts against me. This is a fabrication by the police to harm me. I have faith in justice.

Santiago Malko's mother: Leonard Duka killed my son. He brought Erlis Duka and Ilir Selmani to me and told me that I had nothing to do with Santi, but he went out and killed my son in the middle of the street. I don't want a life sentence, I want the death penalty for this.
