
The Complaints and Sanctions Commission held its next meetings today to review the complaints of the Democratic Party regarding the contestation of the tables of results of the May 11 elections certified by the CEC for all 12 districts.
The KAS also completed the review of appeal request no. 37 (Kukës district) and announced that "the decision will be announced on Thursday (tomorrow), June 5, at 09:50". The DP is seeking the invalidation and repetition of the elections for this district.
KAS has also begun reviewing complaints for Fier and Durrës.
The representative of the DP, Franc Nuri, claimed in his complaint for Fier, where the Democrats lost heavily 12 to 4 mandates to the SP, that there were numerous irregularities, focusing on the use of state machinery and administration, patronage and even 'electoral asphalt', vote diversion and especially the manipulated diaspora vote.
He requested the opening of the boxes, the verification of diaspora votes and unused ballots, a request that the DP later added for the 12 districts it is contesting. The Democrats claim that there are 130 thousand unused ballots that have been manipulated or that are not found in the boxes (because in the minutes the commissioners have marked 0), but so far, from the opening of some boxes such as in Berat and Vlora, this has not proven to be true, as they have been found inside all of them.
After hearing the claims for evidence, the KAS postponed the meeting for Fier for a week, in order to further review or collect them.
The discussion then moved on to Durres, where the presence in the hall of two of the DP candidates, Aulon Kalaja and Ilirjana Kuçana, was noted, who claim vote manipulation within the party, which has removed their mandate in favor of Arjan Ndoja. After discussions with the representatives of KAS, because according to the law, candidates cannot be represented individually, but with the party, the verification of 39 boxes was requested.
Previously, represented by the Legality Party in the appeal, KAS had accepted Aulon Kala's request, but without expressing an opinion on the recount. The two candidates were allowed to attend the meeting, while they claim that there is evidence that their vote was diverted.
Candidate Aulon Kalaja and his representative expressed their position on the verification of 39 boxes where it was alleged that his vote was diverted within the DP and stated that there is evidence that needs to be reviewed.
KAS member Ilir Rusmali requested that the evidence be brought in concrete terms, with details of where those ballots were located, even if they were in more than 39 boxes, but he asked the complainant Kalaja for time and gave him until Monday to gather the facts he would submit.
"You have until Monday to bring not 39 boxes, but 399 boxes if you want. You can only bring your evidence in this form, providing the information and we will act. Bring it and we will verify and review it," he said.
Another member of the team, Elvin Lako, pointed out that in order to make it easier to analyze the footage, the candidate should also have the observers' notes on when problems with the vote were encountered.
"The observers should have kept a record of all the problems with the vote, reported them all, because without those notes it is difficult to check them and find them in the video. So you should search for it with accurate notes, so that it is easier to find it in the video as claimed," he said.
Kalaja stated that they had this information and would submit it. We recall that KAS has accepted Kalaja as a complainant, but has not yet guaranteed the recount they are requesting. In the end, the rapporteur of the case, Elvis Çefa, declared the postponement of the session and the re-convening of the body for a decision on Tuesday, June 10, at 1:00 p.m.
Aulon Kalaja was one of the strongest voices after the end of the voting process, declaring that his vote was distorted within the coalition. He received 7291 votes, while the only mandate of this list was won by Arian Ndoja with 8249 votes. His claim was for the distortion of the preferential vote by requesting the mandate of MP Arjan Ndoja.
