This dilemma was discussed with my team and any claims in the media or from certain parties were analyzed. After a very active discussion, they assured me that, respecting constitutional principles, the president should exercise the constitutional authority to issue a decree for early elections.

The President of the Republic of Albania, Bajram Begaj, has broken his silence regarding the debate on the elections in Tirana. He was invited to "Top Story", where he revealed for the first time why he decided to announce the election date for the capital as well, even though Erion Veliaj has appealed the matter to the Constitutional Court.  

President Begaj said that he has followed the entire constitutional path and legal procedures that respect the Constitution for the dismissal of Erion Veliaj and for the decree of early elections in Tirana. Begaj added that by respecting every constitutional principle he exercised his competence to issue the decree for early elections.

Excerpt from the interview:

-You decreed an election date according to Article 115 of the Constitution, which with a furious reaction from a political party that is the opposition called it a scam, that is, that you had a political bias at the moment you decreed a request for the election date, while Erion Veliaj in the municipality of Tirana, which is known to be the big apple of discussion, has filed an appeal with the Constitutional Court. The Constitutional Court, for its part, says that we have announced the judgment. How do you feel about this decision?

Bajram Begaj: I think that there is no balance in the judgment between the President's decree and the decision of the Constitutional Court. Of course, the mayor was dismissed by the Council of Ministers with a VKM after the proposal made by the municipal council, which, with the votes of the ruling party and the opposition, found the failure to appear for duty as a legal reason. A legal reason that has been widely discussed in the media.

Likewise, the Government, for its part, in the announced decision, analyzes as a cause, not the political cause related to Article 115 of the Constitution, which states "for serious violations of the Constitution and laws", but states that the dismissal of the mayor from office was made with the motivation of failure to appear for duty. So we are dealing with Article 62 point c.

Of course, this dilemma has been consulted with my team and any claims in the media or from certain parties have been analyzed, who after a very active discussion assured me that while respecting constitutional principles, the president must exercise the constitutional authority to issue a decree for early elections. Of course, with the issuance of the decree for early elections, the parties have not been denied the right to bring any possible claim to the legal authorities, but the Constitutional Court expresses itself in a decision and, as far as I know, such a decision has not yet been made.
