The draft law on amendments to the law "On the protection of agricultural land" brought a debate in the Parliament between Socialist MP Erion Braçe and the Minister of Agriculture, Andis Salla.
Braçe raised questions about the number of licenses granted so far for wind and agro-photovoltaic parks on agricultural lands, as well as the use of high-quality lands.
Braçe: Maybe the Minister of Agriculture is not the right person to answer this question, it should be the Minister of Energy, but the question is how many licenses have been granted for wind farms on agricultural lands so far? Second, what about agro-photovoltaic parks on agricultural lands so far? How many permits have been granted for such parks on lands with a land quality of 9 to 10 so far?
In response, Minister Andis Salla said that the draft law constitutes a limited but necessary intervention to adapt the legal framework to the developments of modern agriculture. He emphasized that the main function of agricultural land remains production and that new technologies will be used to increase productivity.
Salla: The draft law is a limited intervention in the law on the protection of agricultural land, but necessary to adapt it to the development of modern agriculture. Land is not simply a surface to be adapted for agricultural production, but a national asset related to economic development and the future of generations. This principle does not change and does not affect the protection of agricultural land. It complements the agricultural framework to put into use some technologies that help to better use water and some nutrients and natural resources, increasing productivity. The reality has changed regarding agricultural land. It is not enough to just cultivate as much surface area as possible, but to have as much productivity as possible. The function of agricultural land, which remains production, is not affected at any time. The philosophy of this law is that technology be placed in the function of the land, the farmer and production. Therefore, it also determines that some criteria be determined by decision of the Council of Ministers, by implementing strict rules."
In his reply, Braçe demanded that the boundaries for the development of photovoltaic and wind parks be clearly defined in the law itself and not by decision of the Council of Ministers, warning that the lack of clear limitations could endanger large areas of agricultural land.
Braçe: This draft law is important. I am concerned about the new law that we have before us. It has not clearly sanctioned the limits set in the existing law, but leaves open that the Council of Ministers sets the limits of agricultural land for carrying out photovoltaic and wind activity. I request that in Article 2, point 6, the limits that the law itself has set for each park be clear and defined. A clearer definition is needed in the law for these limits. Otherwise, these photovoltaic parks will then extend to all agricultural land throughout the country and this is not a good thing. These definitions that have been put into the law do not protect agricultural land. The concept of agricultural land has changed completely. Land is needed for agriculture, not for industry. We do not have endless agricultural land.
