
The Complaints and Sanctions Commission (KAS) ruled in favor of the Assembly, allowing it to approve the so-called "Mountain Package" bill, criticized by experts as a clientelistic bill and considered by the Central Election Commission to be influential on the elections if approved during this period.
"The partial acceptance of the Assembly's appeal was decided by a majority vote," said KAS, overturning the February 11 decision of the State Election Commissioner, Ilirjan Celibashi, who assessed the political effects of the approval of this draft law in the period before the elections.
"The approval of these draft laws, which affect important fiscal policies, could create the perception of using legal means for electoral purposes," said Celbashi.
The Assembly appealed the CEC's decision to the KAS, arguing that the initiative did not create direct benefits for citizens.
In today's session before the KAS, the Director of the Assembly's Legal Service, Mimoza Arbi, stated that the CEC's decision exceeds legal competences and violates the separation of powers by limiting the Assembly's right to review draft laws.
"The Commissioner cannot limit the basic powers or functions of the Assembly as granted by the Constitution. The Commissioner's recommendations cannot override the constitutional powers of the Assembly. Institutional independence is also violated through this recommendation," stressed Mimoza Arbi.
Along with the mountains package, KAS also allowed the Assembly to make changes to the VAT scheme for agriculture, as it does not violate pre-election rules.
The "Mountain Package" has also been met with opposition from civil society organizations and experts in the field. They list the lack of transparency, clientelism, and avoidance of regular legal procedures for this initiative.
The head of the CEC, Ilirjan Celibashi, blocked another initiative of the Parliament. He requested that Nasip Naço's initiative that allows prisoners with less than 2 years and months of sentence to leave their cells and work not be approved.
