The Council for Mandates and Immunity has opened the way for the arrest of Sali Berisha. After more than 4 hours of debates and discussions, with 6 votes in favor it was decided to accept SPAK's request.
The Special Prosecutor's Office accuses Sali Berisha of not respecting the security measure established by two judicial levels. Berisha is under investigation for corruption with the former "Partizani" complex, while he has been given a "appearance obligation" security measure. He did not implement the measure and SPAK has asked the Assembly to allow the imposition of a more severe security measure against him, either "house arrest" or "prison arrest".
Berisha decided to boycott the meeting of the Council of Mandates. He sent only his 2 lawyers, Sokol Mëngjesi and Genc Gjokutaj. Likewise, 4 opposition MPs refused to participate. Only Alibeaj was present. It should be noted that Alibeaj was one of the most attacked by Berisha.
Berisha's lawyers argued for a long time with the prosecutors and members of the Council, grasping at the fact that SPAK has violated the Constitution by imposing the "obligation to appear" measure. According to them, he is being tried for political arrest.
“From the description it is clear that Mr. Berisha is being prosecuted today for his political activity, at the time he refers to SPAK, when he was prime minister of the country, until today . An unprecedented case that undermines every principle of a democratic society, to accuse a deputy and leader of the opposition of having committed corruption by approving laws or bylaws in fulfillment of his political function. This proves that we have a criminal process in which Berisha's freedom is being taken away, when it basically consists of insinuations and political positions of the opposition leaders' career. Because for the laws that the Assembly refers to, there is no legal initiative either from the opposition of that time, or from other groups to establish these laws. This is a dangerous situation and an alarm bell not only for Berisha today but for all representatives elected by the Albanian people that they cannot freely exercise their political functions", said Sokol Mêngjesi.
For their part, the prosecutors said that they are sure of Mr. Berisha's corruption. Arben Kraja stated that he does not implement the court's decisions and that is why they made the request. According to him, he is like all citizens and the law is the same for everyone.
“We asked for toughening, because he did not implement the court's decision in three cases. From the assessment session of the measure, we found that when they went to submit the documents, the doors were closed. It is not hidden that he is in the media and TV every day, but we tell you that he does not implement the decisions, he is a citizen of the republic, and as such he is equal before the law", he said.
Earlier, Berisha's lawyers requested the suspension of the meeting, with the argument that they have filed a lawsuit in the Constitutional Court and its decision should be awaited. But the majority together with Alibeaj overthrew him.
In the end, as expected, the Mandates and Immunities Council did not create any obstacles. 5 representatives of the majority and Alibeaj himself voted in favor of the request. Now the report will go to the plenary session and as soon as the report is approved, SPAK has the right to ask the court for a more severe security measure against MP Berisha. It is known that the voting will take place in the session of Thursday. On the same day, Berish called a protest in front of the Parliament, as he did today. /Pamphlet
