Democratic Party MP Bujar Leskaj has proposed a draft law in the Albanian Parliament that aims to establish direct financial liability for public administration employees who cause economic damage to state institutions.
According to the legal initiative, any state employee who intentionally, through negligence or lack of professionalism, causes financial damage will be forced to pay for it from their personal income. The draft law also includes cases where officials sign in violation of the law under orders from superiors, aiming to put an end to the practice of abusive signatures without accountability.
The draft law defines three forms of financial liability: full, limited and joint. In the case of full liability, the public official pays for all the damage caused. When the payment is not made within 10 years with 50 percent of the monthly income, this limit is applied as a maximum. In joint liability, each person pays only the part of the damage he or she caused.
The initiative also provides for measures for unintentional violations, but with financial consequences, where the official is forced to pay up to 7 gross monthly salaries and no more than 25 percent of the damage. Managers are also held responsible for violations by their subordinates. Financial liability is excluded in cases where employees have acted under serious threat to life, aiming to protect the administration from illegal pressure from superiors.
