
Deputy Oerd Bylykbashi, speaking about the ongoing trial against former Prime Minister Sali Berisha, who is under investigation for the "Partizani" case, explained why it was requested that Judge Irena Gjoka no longer be part of the trial.
In an interview for the show "Now" on "Euronews Albania", he stated that she violated the law and abused her duty by allowing the deputy to be investigated without the authorization of the Assembly.
" Article 288, which explicitly states, when a member of parliament is to be given the security measure of "prison arrest" or house arrest, deprivation of liberty in any form, control of the apartment, the prosecutor must request authorization from the parliament. The judge says, when the measure is set, it should be taken into account that the authorization of the assembly has been requested from the prosecutor. What they have done, they have canceled article 73 of the constitution. The judge has undertaken to make a constitutional court, which even she cannot do. So there is a criminal complaint for abuse of office, for violation of the constitution and due process, under these conditions it cannot be part of the trial ", said Bylykbashi.
