The race for the leadership of the Democratic Party risks ending in court. Democrat Alesia Balliu, after her candidacy was not accepted in the race for the leadership of the party, said that she will continue her legal battle to oppose the electoral process within the party.
She said that she is waiting for the deadlines, until the last day, and then she will follow the institutional side. Balliu said that she will follow all steps to prevent Sali Berisha's candidacy.
This stance was previously announced by the democrat. Balliu has stated that the criteria have not been recognized, emphasizing that the process is taking place without real competition.
"She does not meet the criteria. She does not meet the first criterion, because she must be prominent and has not held leadership positions or high positions. So we are waiting to see what the decision-making will decide."
Important today is the fact that Sali Berisha will compete with himself, has usurped the DP and is using it as a shield against justice. With Berisha, the DP does not win and with Berisha, the Democrats have every door closed with the internationals. The DP has no way of raising hope for Albanians. "In the absence of competition and meritocracy, I will definitely refer to the court. I am waiting for the deadlines, as a lawyer that I am. I will wait until the last day. However, the leader of the DP risks ending up in court again, and the reason is Article 46.
This article states: "If, after the announcement of the results of the general elections for the Assembly, the Party does not emerge as the winning governing force, the mandate ends immediately and automatically due to the Statute. In this case, the chairman whose mandate ends is not allowed to run in the subsequent elections for party chairman."
On May 23, the DP holds elections for the mayor and Sali Berisha has decided to run again, not implementing this point of the article with the argument that the elections were stolen. A week ago, Alesia Balliu addressed the DP Presidency in a letter, requesting the termination of Berisha's mandate as DP leader, after losing the May 11, 2025 elections. The letter states that Berisha has been exercising the duty of DP leader without a mandate since September 9, 2025.
Referring to the provisions of Article 46, dubbed by Berisha as the "Basha" article, Balliu says that Flamur Noka should be appointed as the leader of the DP, in the position of the Commander-in-Chief of the DP until the election of the new leader.
"As this provision clearly states, the mandate of the president has ended on 04.09.2025 and since that date, citizen Sali Ram Berisha can no longer exercise the functions of the president of the DPA, as such an action conflicts with an imperative provision of the Statute. In accordance with Article 48 of the Statute, it is the duty of the DPA Presidency to, in the absence of the institutional will of the usurper of the position of president of the DPA, take the necessary institutional actions to establish the legitimacy of the governing bodies of the DPA," the request states.
Referring to the statute of the Democratic Party, Balliu requested not only the conclusion of Berisha's mandate, but also the ban on Berisha's candidacy for the post of mayor in the elections of May 23, 2026.
Her letter emphasizes that "any decision-making by Berisha after 04.09.2025 is absolutely invalid and, as such, cannot bring legal consequences as long as the body that took them was not in function after the end of the mandate."
Date 04.09.2025 marks the entry into force of Decision No. 34 of the Regulatory Commission and Decision No. 30 of the Electoral College, which have been recognized and respected through conclusive actions by the DPA.
