Enkelejd Alibeaj asks the president Bajram Begaj not to decree the new Electoral Code. The opposition deputy came out against the Rama-Berisha pact to partially open the lists of deputies.
Alibeaj expresses in a reaction that this Code violates the principle of equality and asks the president to reject it.
" Our concern is summed up in the impossibility that Albanian voters will have to choose their representatives outside the will of the party leaders. In the event that this law will come into force, next year Albanians will be offered by traditional parties only a preferential list of the president. These candidates will not pass any selection or merit filter, but will be the privileged ones of the mayors who will be offered to Albanians as the ONLY alternative ", he says.
Alibeaj's reaction
I submitted today to the President of the Republic, the request for the non-decree of the law "On some additions and changes to the law 10019, dated 29.12.2008 "Electoral Code of the Republic of Albania" as amended", approved by the Assembly of Albania on 26.07.2024.
The legal reasoning for this request is based on the fact that the law approved last night violates the constitutional principles provided by articles 17, 18, 45 and 64 of the Constitution and is contrary to the spirit, reasoning and conclusions reached by the Court's decision 28/21 Constitutional.
Also, this law is contrary to the right recognized by the state to limit constitutional rights (the right to choose by preferential vote); contrary to and in violation of the principle of proportionality (restriction or removal of a right in proportion to the public interest). The adopted law is contrary to the spirit and reasoning of the Constitutional Court, which determines that the interest of political parties in self-regulation cannot limit beyond the proportional need the right of citizens to select their representatives by preferential vote.
In other words, our concern is summed up in the impossibility that Albanian voters will have to choose their representatives outside the will of the party leaders. In the event that this law will come into force, next year Albanians will be offered by traditional parties only a preferential list of the president. These candidates will not pass any selection or merit filter but will be the privileged ones of the presidents who will be offered to Albanians as the ONLY alternative.
