In the file of 200 pages discovered by the media, other details have been revealed from the affair of the privatization of the former Partizani complex.
It is revealed that Jamarbër Malltezi and Fatmir Bektashi had started the work for the liquidation of the company Homeplan sh.pk, which has served over the years as a company for the distribution of benefits. According to SPAK, the benefits that Malltezi received from this company were worth 5.4 million euros.
It is known that exactly on October 4, 2023, exactly 16 days from the date when GJKKO made the decision to arrest Malltez, the decision dated 03.10.2023 for the transition of the company to "liquidation in progress" status and the appointment of a liquidator was filed with the CKB. Malltezi himself was arrested on October 21 at the Rinas airport as he went out to meet his wife, the daughter of Sali Berisha, Argita, who was returning from Germany.
"The court assesses that due to the circumstances of the fact, there is a risk that those investigated above will commit serious crimes or crimes of the same type as the one for which they are being prosecuted. The court reaches this conclusion, taking into account the fact that during the investigation phase , the two investigated have undertaken concrete actions aimed at the liquidation of the company Homeplan sh.pk, which has served over the years as a company for the distribution of benefits. Thus, on 04.10.2023, the decision of dated 03.10.2023 for the transition of the company to "liquidation in progress" status and appointment of the liquidator.
After the filing of this decision, the status of the company Homeplan sh.pk has changed from "Active" to "Company in liquidation in progress". Based on the above actions carried out by the investigators, the court considers that there is a risk that the above investigators will commit serious crimes or commit 11.4 ms" is argued in the decision of GJKKO that calls SPAK's request for arrest right of Malltez.
According to the charge of SPAK
All the monetary benefits that the citizen JM received as an investor from the company "Homeplan" sh.pk, without investing in the latter, benefits received before he was declared as a spouse in this company, the profits accumulated over the years company as well as those distributed in the following, after 2018, calculated in total in the amount of 672 976 832 lek or 5 420 345 euros.
It is also estimated that for the three investigators Jamarbër Malltezi, Sali Berisha and Fatmir Bektashi, the second special condition provided by letter "b", point 3, of article 228 of the Penal Code is fulfilled, as the court estimates that due to of the circumstances of the fact there is a risk that the interrogators will leave.
"The court reaches this conclusion, taking into account the high margin of punishment that sanction the criminal offenses for which they are suspected, where article 245 of the Criminal Code provides for imprisonment from 1 to 5 years, article 260 of the Criminal Code provides for punishment with imprisonment from 4 to 12 years, while Article 287, second paragraph of the Criminal Code provides for a sentence of imprisonment from 7 to 15 years. For the above, the court appreciates the existence of the risk of escape of the persons under investigation, it is written in the file.
