In the document of the British file for the ban on the entry of Sali Berisha, the opponents of the former president and the former Albanian prime minister are also included.

In the "Special Commission of Immigration Appeals" where the unprecedented appeal took place when a former prime minister opposed the decision of the British government, Berisha's lawyers gave their arguments as to why the decision of the secretary of state Priti Patel was unfair.

"Decision-makers cannot base their findings on facts unsupported by evidence or based on views that cannot reasonably be sustained. The accusations of the secretary of state for criminal and corrupt involvement taken into consideration are false statements and not based on facts", declared Berisha's lawyers.

The essence of other objections to the decision, according to Mr. Berisha's lawyers, relate to these aspects:

"The Secretary of State legally cannot consider actions taken when Mr. Berisha was prime minister or president. The ban on entering the UK is politically motivated and influenced by opponents.

Based on the doctrine of sovereign immunity, this prevents Great Britain from denying entry to Sali Berisha or a head of state in office or not in office in relation to involvement in abuses during the period of leadership.

The Albanian government had information earlier that the appellant Sali Berisha would be banned from entering Great Britain. The last two British ambassadors are not impartial.

"For the construction of the energy park, Mr. Berisha is not potentially involved in any criminal act related to this issue," emphasized Berisha's lawyers.

During the review of the appeal in the "Special Commission of Immigration Appeals" the Ministry of Internal Affairs Home Office said this argument in rejecting the claim of the former democratic prime minister that "the ban on entry to Great Britain is politically motivated and influenced by opponents.

"Appellant Sali Berisha was one of a number of individuals for whom the entry ban has been recommended to the Secretary of State. This group was politically balanced with involvement from all sides of Albanian politics", the document states.

Lisa Giovannetti KC, representative of the English government in this process, in response to Mr. Berisha's claims, told the court that before making the decision, the State Secretariat consulted with the Ministry of Foreign Affairs, the Foreign Office, from where it received this opinion.

"There is a low probability and risk that the appellant Sali Berisha could hold positions in the government, potentially as prime minister or president. The Ministry of Foreign Affairs Foreing Office and the European Union in Tirana estimate that the Democratic Party is unlikely to be successful in the upcoming elections.

 We do not rule out the possibility that this will happen, as the appellant Sali Berisha may be the chairman of the DP. He is 77 years old, maybe he can be replaced by someone younger until the 2025 elections but this is not guaranteed" , Lisa Giovannetti KC, representative of the British government told the court during the appeal undertaken by the former democratic prime minister, Sali Berisha./ TCH
