"The government is trying to eat up other powers", Lutfi Dervishi:

Journalist Lutfi Dervishi, invited to the "Off the Record" show on A2 CNN, commented on the recent tensions between the executive and justice institutions, describing them as a positive sign of institutional autonomy.

According to him, reactions to court decisions show that the executive is attempting to expand power beyond constitutional limits.

Dervishi stressed that the courts and the prosecution have never shown ambition to interfere in the governance of the country, on the contrary, they were established precisely to keep those in power under control. Referring to the Special Court, he stated that its decisions are accepted without comment when they affect the opposition or dismissed officials, but are opposed as soon as current government officials are affected.

According to him, the concept of immunity cannot be used as a shield for administrative actions, as those in power are directly responsible for their decisions. “You cannot ask not to resign in the face of a concrete accusation and still remain a minister. This is not a standard of governance,” he said on Off the Record.

Dervishi argued that the current clash between the executive and the justice institutions is “the end of a long hypocrisy” and a healthy sign of democratic functioning. He also praised the Court’s latest decision, emphasizing that it is reasoned and is expected to serve as a norm for other cases, just like the precedent of the Sali Berisha decision.
