The deputy of the Democratic Party, Jorida Tabaku, reacted to the government's request for salary increases for the members of the Constituent Assembly. She stated that the government's demand for salary increases violates the independence of justice institutions and the logic of a hierarchy system.
Tabaku described the request as meaningless, since according to her, there was no reason for it to be done by the government, but it could come in a different way.
She added that the request of the Ministry of Justice on behalf of the Constitutional Court for a salary increase for the members of this court is not related to the package of legal changes for the Reform in Justice.
"For several weeks, a request from the Albanian government, namely the Ministry of Justice, has been filed in the Assembly of Albania, which requests an increase in the salaries of the Constitutional Court. A senseless request considering that the latter is not at all an institution dependent on the government (much less the Ministry of Justice) and that could have come in a completely different way.
A request that comes while in the Assembly of Albania in the meantime there is a package of legal changes waiting to complete and fill some gaps that the new justice system needs. Changes proposed by the newly established institutions and our partners who have invested in the Justice Reform. Although the institutions in their points for changes have also presented salary increases, the Constitutional Court has not raised this concern in any of its documents or requests during the debates on the changes in question.
In short, the request of the Ministry of Justice on behalf of the Constitutional Court for a salary increase for the members of this court is not related to the package of legal changes for the Reform in Justice. They are two unrelated things. I fully agree and support the legal changes of the Justice Reform as it preserves the principles of a fair evaluation system for all judges and taking into account their difficulty in work.
Where is the problem with the government's proposal to increase the salaries of the Constitutional Court?
Në qershor të 2023 në fund të sesionit, parlamenti i Shqipërisë votoi për rritjen e pagave në gjithë hierarkinë shtetërore duke nisur nga kryetari i shtetit presidenti, parlamenti dhe padyshim edhe sistemi drejtësisë. Ndryshime që preknin të gjithë hierarkinë shtetërore brenda formulës së përcaktuar nga Kushtetuta dhe interpretimi Gjykatës Kushtetuese.
Tani është e qartë që këto ndryshime për rritje të pagës së Gjykatës Kushtetuese me propozim të qeverisë nuk kanë asnjë lidhje me Reformën në Drejtësi dhe cënojnë jo vetëm pavarësinë e institucioneve të drejtësisë por edhe logjikën e një sistemi hierarkie page që kanë këto institucione.
Së pari, pavarësia institucionale. Si institucion kushtetues, Gjykata Kushtetuese i dorëzon të gjitha kërkesat për buxhet në komisionin e ligjeve në parlament. Në teori nuk duhet të ketë varësi nevoje me asnjë institucion tjetër. Megjithëse GJK ka një marrëdhënie të qartë me Kuvendin ajo prapë ka vendosur t’i bëjë një kërkesë Ministrisë së Drejtësisë, pra ekzekutivit. I ka kërkuar qeverisë që t’i kërkojë kuvendit që t’i rritet paga anëtarëve të GJK. Kështu, qeveria që po propozon t’i rriten pagat Gjykatës Kushtetuese, duke cënuar rendë si pavarësinë por dhe balancën e pushteteve.
Së dyti, drejtësia e vendosjes së pagave. Reforma në drejtësi (ajo që i tundin flamurin sa herë i duhet) ka krijuar SPAK/GJKKO, për hetime/gjykime të korrupsionit e krimit të organizuar. Kjo gjykatë është ajo e cila për momentin po përballet me vendime që kanë lidhje me korrupsionin qeveritar, me krimin e organizuar e duke shënjuar rezultate që pak i kishin menduar.
Ato janë gjykatësit më të kontrolluar e monitoruar. Duke pasur këtë situatë kaq komplekse dhe mbi të gjitha dhe hierarkinë e pagave në këto institucione duket e padrejtë që Gjykata Kushtetuese të kërkojë vetëm për veten e saj përmes Ministrisë së Drejtësisë rritjen e pagave me 100% më të larta se sa gjyqtarët e GJKKO. Kjo është pandershmëri dhe mungesë serioziteti pasi kështu prishen të gjitha parimet me te cilat është ndërtuar reforma në drejtësi.

Simple: GJK is independent and must continue to be independent! Its independence is damaged in its image and not only by its transformation into an additional annex of the Ministry of Justice. But also low political tricks that break the hierarchy!", writes Tabaku on Facebook.
