The Constitutional Court will meet today regarding the government's appeal against the suspension of Deputy Prime Minister Belinda Balluku. Following the GJKKO decision, the government filed an appeal with the Constitutional Court, where the Prime Minister claims that the court's decision is unconstitutional, as it has interfered with his powers.

The court initially convened on Thursday of last week, but the College meeting was postponed until today, where it will decide whether or not the government's request will go to a plenary session.

" The Panel met today as scheduled. At the request of Judge Marsida Xhaferllari, who had received notification of the acts on the afternoon of 26.11.2025, and in accordance with Article 24 of the Rules of Court Procedure, which provides that judges must have the request and the request acts at their disposal at least two days before the Panel meeting, it was determined that the review of the case will be carried out by the Panel on the first working day after the official holidays in November, specifically on 02.12.2025 ," the court announced on Thursday.

In the request sent to the Constitutional Court, the Council of Ministers states that the decision of the Special Court to suspend the Deputy Prime Minister and the Minister of Infrastructure and Energy directly interferes with the competencies of 3 state bodies: the Prime Minister, the President, and the Assembly.

" The suspension brings serious consequences for the state and social interest by creating an institutional vacuum as it prevents the proposal of projects of national importance for integration into the European Union, around 800 projects to be approved by the end of 2027 by the ministry led by the minister, who has been suspended through the decision of the GJKKO ," the Council of Ministers reasons.

According to the government, Belinda Balluku could not be suspended from office, as in her capacity as a member of the government she enjoys the rights of an MP.

The government in its arguments refers to Article 103 of the Constitution, which expressly states:

1. Anyone who has the qualifications for a deputy may be appointed as a minister.

2. The Minister may not exercise any other state activity nor be a director or member of the bodies of for-profit companies.

3. Members of the Council of Ministers enjoy parliamentary immunity.

Prime Minister Rama also reacted yesterday regarding the GJKKO decision. He stated that there is no pressure on the Constitutional Court, while continuing to insist that there is a violation of the Constitution.

" Regardless of me, us, of those who are today and are not tomorrow. If the suspension of a minister by a prosecutor and judge were to be legitimized as a legitimate right of justice, then extending the judiciary's arm beyond the dividing line with the executive branch would create a dangerous and threatening precedent, because by opening the way to political pressures on the government, institutional destabilization would occur, something that is unknown in Europe.

You have to be completely blinded by hatred to turn this conflict of powers between the executive and the judiciary into a political conflict, as the drowned in the swamp do for everything. They can't find it because it doesn't exist and they don't know how and where to get it. The suspension of a minister at the initiative of a prosecutor and a judge is a usurpation of the prime minister's powers , "said Rama.
