The Socialist Party parliamentary group has gathered at the Presidency of the Assembly to review the Special Prosecution's request for the arrest of former Deputy Prime Minister Belinda Balluku. Prime Minister Edi Rama is also expected to speak at the meeting.
The preparation of the report of the five socialist deputies to the Mandates Council has been entrusted to the chairman of the Laws Committee, Ulsi Manja. The chairman of the parliamentary group, Taulant Balla, has requested the presence of all deputies at the meeting.
Belinda Balluku herself also participates in the meeting.
The Socialists have not publicly expressed a final position, but internal discussions have suggested that her removal from office is seen as an element that does not justify granting an arrest warrant.
This argument was also mentioned by Prime Minister Rama during the meeting with the parliamentary group and the government cabinet, when he announced the changes in the government and Balluk's removal from office following the Special Court's decision to suspend her from office.
The Constitutional Court then examined the case and found that a minister does not benefit from the exceptions of Article 242 of the Code of Criminal Procedure for the measure of suspension. Its members were divided in their interpretation on the procedure to be followed for the implementation of this measure and whether or not the authorization of the Assembly is required.
Following this development, the parliamentary majority proposed amendments to Article 242/2 of the Criminal Procedure Code, including prohibiting suspension for members of the government, the president, and heads of independent institutions.
The plenary session on March 12 will consider the request for authorization of arrest. The Democratic Party has published its report supporting the SPAK request.
SPAK has taken Belinda Balluku into custody for the Llogara tunnel construction procedures and is also investigating the seven lots of the Great Ring Road project. The prosecution accuses her of violating equality in tenders.
