Journalist Klodiana Lala has revealed details regarding SPAK's request to change the security measure for former Prime Minister Sali Berisha. Lala revealed the next move of Berisha, who said that the former prime minister's lawyers are expected to file an appeal.
She also said that according to the law, the Council for Regulation, Immunity and Mandates will be convened, which will hold a session where Berisha himself will appear.
According to Lala, the procedure will have to be closed within a 15-day period and after the approval of the request in the parliamentary session, then the Court will examine the request for the new security measure, that of "house arrest".
"This request comes after citizen Sali Berisha has repeatedly failed to comply with the request to appear in court. In the October decision, in his absence, the measure 'obligation to appear' was set. Former Prime Minister Berisha did not appear in court, so the Court of Appeal held the position that the measures of 'obligation to appear' and 'ban on leaving the country' should remain in force. All claims against Berisha have been rejected. Berisha was supposed to appear in court on December 18.
I want to emphasize that Berisha is not a defendant, but a person under investigation. If you look carefully at the layers, it says prison and house arrest. The law provides that persons over 70 years of age cannot be imprisoned, except in special cases. If Berisha's parliamentary immunity is removed, the Prosecutor's Office has free hands to request coercive measures. SPAK requests this measure after Berisha ignored the court order.
