SP plan to attack SPAK after the elections, how is the plan being woven...
All the focus these days is on the elections and the diaspora vote. Although the campaign is still far away, the parties have started working and this situation is being used very well by Edi Rama. Undoubtedly, winning the elections is the main priority of the SP, but what is definitely being sought is securing a qualified majority. Which, to tell the truth, will not be so easy to achieve, since looking at the polls, there is a significant increase in new parties. And this is the reason why it has launched an attack for votes.
But the reason Rama covets 84 mandates is the project he drafted with Fatmir Xhafa. The latter has taken over the leadership of the Anti-Corruption Commission, which is working under the rug. In the first 3 weeks of this month, two meetings were held and in one of them, several important decisions were made, which have remained in the shadows. At the meeting on January 17, experts presented the draft Analytical Document to the commission, on the basis of which legal changes will be determined later. The plan is for these laws to be changed after the elections, since some require 84 votes.
What is striking in the analytical document, which was obtained by "Pamphlet", is that there are several elements that signal that there will be an attempt to duplicate SPAK. It also seems that this commission will undermine justice, channeling the investigation to lower levels and not higher ones.
" Corruption does not only come from high-ranking officials, but is found everywhere and in various forms, therefore it is judged that the existence of a totally independent institution, whose main goal is the fight against corruption, should also centralize all information from various sources, because this would be an added value in the process of effectiveness and the process of declaring assets or individual income, for all employees in both the state and private sectors ," the document states.
In this passage, it is not clear whether the intention is to review the competencies of SPAK, or to create another anti-corruption institution.
Also, in the wake of this, it is requested that the assets of the entire administration and not just politicians be investigated. So, justice will be drowned in files on lawyers, financiers, guards, etc. and ministers and senior officials will be left alone.
" In terms of investigating corruption, the basic element is the employee's wealth, which is directly related to corrupt affairs. In our country, there are independent institutions, but also institutional structures, which aim to fight corruption, identify and prevent conflicts of interest and identify the wealth of employees over the years, both in the public and private sectors. The impasse that arises is that the wealth investigation, which is initially carried out only for senior officials/managers, is not carried out for all employees, therefore the process of tracing money derived from corruption should be reviewed from the perspective of its effectiveness, with the aim of prevention and punishment ," it is further emphasized.
The interesting thing is that such conclusions come at a time when SPAK itself seeks not to deal with second-hand corruption at all. But only with those in power. Meanwhile, another absurdity is that SPAK itself states that it has hit hard on the assets of corrupt and criminal elements, seizing millions of euros, but according to Xhafaj's analysts, not much has been done in this regard.
" Addressing the low number or lack of financial investigations parallel to the investigation of criminal offenses that generate criminal proceeds/income. In this regard, it is important to increase the number of systematic financial investigations for criminal offenses that generate proceeds/income, taking into account the initiation of a parallel financial investigation at the moment of registration of criminal proceedings; increasing the number of seizures/confiscations, including cases of their alienation by third parties; as well as cooperation with relevant institutions for the management of these proceeds/assets... ", the document emphasizes.
So if we look at these definitions, it is clear that after the elections there will be fundamental legal changes, which in the field of corruption will create clashes with SPAK. It remains to be seen what plans Xhafaj has, but it seems that from all this commitment of the commission, the lower levels of the administration will suffer and politics will save itself. / Pamphlet
