
Lawyer Edmond Petraj stated that the debate between the judiciary and the executive shows serious problems in legislation and legal vacuums. He emphasized that the judiciary must be protected from any pressure that violates its independence.
According to him, the GJKKO decision has created direct interference in the executive, violating several articles and the Constitution. Petraj added that the justice reform is showing shortcomings and the Constitution should also be intervened in.
" The debate between society and judges shows that there is a separation of powers in the country and that the government has the right to criticize public decisions. But, at the same time, the judiciary must be protected from any kind of pressure or debate. The decision of the Court that came out of the GJKKO which, based on procedures that contain legal vacuums, has created interference in the executive branch, an institution that in itself should be independent. The blow that occurred, as a result of these legal vacuums and articles that create a conflict of interpretation, contradicts the Constitution and raises concerns about the way in which the suspension of a minister works. Under these conditions, another institution should take the situation into consideration. The reform in the judiciary is showing its defects and requires intervention, including possible constitutional amendments.
In the conflict between the two powers, the judiciary and the executive, there should be no silence. This applies both to the case of Altin Dumani, where anathematizations have been made, and to the Judiciary, which should have reflected on the issues raised regarding judge Irena Gjoka. Today we have a decision that is not clearly addressed to the public and that raises suspicions of interference in constitutional functions. The principle of non-interference has been violated, affecting the normal functioning of the constitution. Now the question remains: are we facing a fact that definitely requires the regulation of this constitutional defect? " , he said in an interview for 'AbcNews'.
