Fatmir Xhafaj, chairman of the Committee for Civic Initiatives and Institutional Oversight, seems not to give up on the idea of controlling SPAK. After the rejection of the Special Prosecution Office to the request of the socialist deputies who wanted to inspect SPAK, it seems that Xhafaj has chosen another path, the involvement of the Albanian Parliament in the “kneeling” of this institution. But the first obstacle for Fatmir Xhafaj was created at the Conference of Speakers, where he attempted to approve the annual calendar of the Committee’s activities.
The submitted draft calendar includes inspections and controls in justice institutions, including the Supreme Court of Justice, the Supreme Court of Justice, the Supreme Court of Justice and the Supreme Court of Justice.
But it seems that disagreement among members of the Conference of Presidents has caused the submitted draft not to be approved.
" The third item on the agenda was the review of the annual draft calendar "On parliamentary oversight for the year 2026", proposed by the Committee on Civic Initiatives, Cooperation and Institutional Oversight. After discussions, the Conference of Speakers did not reach an agreement ", the official announcement of the Assembly states.
Under such conditions, MP Fatmir Xhafaj, in his capacity as Chairman of the Committee on Civic Initiatives, has invited his colleagues, the chairs of parliamentary committees, to give their opinion and approve it in the Committee on Civic Initiatives, Cooperation and Institutional Oversight for the continuation of the work.
The draft calendar foresees not only visits and monitoring meetings, but also hearings with the heads of institutions, or joint round tables. The draft that did not receive the consensus of the members of the Conference of Presidents includes all institutions, which seems to be simply a camouflage to cover the main purpose: monitoring the justice institutions, especially SPAK.
It is not known what stance the 4 heads of the Parliamentary Committees belonging to the opposition will take, but most likely, they will be against the extension of controls to the new justice institutions.
The nonsense in what is proposed in Xhafaj's draft calendar, at least in the case of SPAK and GJKKO, is the overlap of the Assembly with the two supervisory institutions of the Prosecutor's Office and the Special Court, respectively the KLP and KLGJ. It is these institutions that, referring to the way the new justice is organized, should exercise controls, even through hearings, with the leaders of SPAK and GJKKO.
Xhafaj and SP deputies, members of the Committee for Civic Initiatives, undertook a tour of visits to several of the country's courts, using as an argument the adoption of security measures in the courts, after the serious incident that occurred at the Court of Appeal in Tirana, where one of the judges was killed in the courtroom. Upon completion of the inspections in the District Courts, Xhafaj addressed a request to SPAK to extend the control to the Special Prosecutor's Office, but was rejected.
" Any practice of conducting such monitoring visits would conflict with the constitutional independence of the Special Prosecution Office. This independence is not only a formal legal requirement, but also a fundamental condition for ensuring independent, impartial and efficient investigations, in the protection of the public interest and the rule of law," SPAK's response stated.
Following the response to Xhafaj, SPAK emphasizes that it is willing to transmit information while fulfilling constitutional obligations, but not to be monitored.
But Xhafaj, it seems, will not give up and of course the goal will not be to obtain information, but to monitor SPAK, or in other words, an attempt to keep it "under control" using the parliamentary mechanism. / Pamphlet /
