
The decision of the Appeals and Sanctions Commission (KAS) that ousted CEC head Ilirjan Celibashi for 'blocking' the counting of Greek votes has been made public.
In the leaked document, KAS says that the chief commissioner's decision was issued in violation of the Electoral Code, as this competence belongs to the Regulator.
The KAS finds that the act of the chief commissioner has a normative sub-legal character, but according to the law, the competence to approve such acts belongs exclusively to the CEC Regulator. The latter has previously approved the complete rules for the administration of votes from abroad with decision no. 22, dated 20.03.2025 and decision no. 33, dated 08.05.2025, which include every step of the process from the delivery, opening and verification of the boxes, to the counting and evaluation of votes.
According to the KAS, only the Regulator has the right to change the rules for voting from abroad, with decisions taken by a qualified majority.
"The Commissioner's Decision No. 1121, dated 12.05.2025, was issued in violation of the letter "n" of point 1, article 19, of the Electoral Code, because the Commissioner cannot exercise powers that have been expressly granted to the Regulator or the KAS. This decision is also in violation of the letter "dh" of point 1, article 20, of the Electoral Code, because the adoption of rules for voting procedures, for the administration and counting of votes from abroad is the exclusive competence of the Regulator," the KAS decision states.
In conclusion, the CAS ruled that the Commissioner's decision is in clear violation of the Electoral Code and the Code of Administrative Procedures, and is therefore repealed as an invalid act. Its further implementation is prohibited, while the existing decisions of the Regulator remain in force.
Yesterday's decision by the KAS came after the request filed by the Socialist Party opposing the act of Chief Commissioner Celibashi to separate the envelopes arriving from Greece following the request of the Democratic Party.
