The former vice-president of the Serbian List, Milan Radoicic, who took responsibility for the terrorist attack in the village of Banjska on September 24, when a member of the Kosovo Police and three members of the terrorist group were killed, has given a statement to the Ministry of the Interior of Serbia and his lawyer Goran Petronijevic claims that he can probably be held responsible for possessing weapons.

However, legal experts in Serbia think otherwise.

Lawyer Ivan Ninic told Dana that before the prosecutor starts dealing with Radoicic, it seems that he should first consult with Vucic if he will respect the Constitution of Serbia or the Brussels agreement.

" If we still consider Kosovo a part of our territory, then prosecutorial actions in the pre-penal procedure should cover a much wider scope than carrying weapons without a permit. I think that the primary issue here is the death of four people and the wounding of some of our citizens, and then the possession and carrying of weapons without a permit ," Niniç emphasized.

He adds that if the thesis of the state and the prosecution is that the Brussels agreement is over the Constitution of Serbia and that we have no jurisdiction in the territory of Kosovo, then Radoicic can only be accused of weapons possession.

" I wouldn't be surprised if Vučić tried such mediation and forced Radočić to enter into a plea agreement with the prosecution. This means that he should immediately be sent to prison and try to save him, at least temporarily. However, I am not sure that such a scenario will be acceptable to the international community as long as Serbia blocks Kosovo's entry into international institutions , Niniç added.

According to him, "when you protect criminals, there is a price that must be paid in the end, and we will pay it as a nation".
