The draft statute of the Association of municipalities with a Serbian majority continues to be at the center of discussions. Although this draft statute has not yet been officially published, the EU spokesperson has hinted that they do not disclose the documents. Meanwhile, the draft statute is considered unfavorable for Kosovo by experts on the Constitution.
The spokesperson of the European Union (EU), Peter Stano, in an answer to Rtv Dukagjini, has said that the EU's proposal for the Association has not been made public.
Stano has said that they do not reveal the documents and do not participate in the debate about them. "We never disclose official documents publicly, nor do we engage in public exchanges about them while they are being discussed." - he said.
Stano said that international mediation is a confidential process, as he said that the new proposal is more balanced. "Regarding the draft statute of the Association of Serbian Municipalities, we can only recall that a new balanced European proposal for the establishment of the Association of Municipalities was presented to the relevant partners by the EUSR for the dialogue of Belgrade in Pristina during his visit to the region at the end of the month of October. It was then discussed with both sides during the leaders' meeting on the sidelines of the European Council." - he said. Meanwhile, several drafts have been published in Kosovo, but so far they have not been formalized and have been denied by the Government of Kosovo.
However, these drafts are being commented and analyzed by experts in the field. The former president of the Constitutional Court of Kosovo, Enver Hasani, in an interview for Radio Free Europe, commented on the draft statute of the Association proposed by the West, saying that Resolution 1244 and Arbitration are among the red points in this draft. Hasani said that the Association creates political-territorial autonomy and has significant state powers.
"This content of this statute is a direct derivative of the Brussels Agreement, namely the Ohrid annex. That is, it is dedicated to the implementation of a political-territorial autonomy, which has significant constitutional authorizations, state content. The part of competences, which has to do with economic, cultural development, political representation, all of them are the responsibility of the Republic of Kosovo and the responsibility of the Constitution, as in all other countries of the region, and now those competences are usurped by the Association. On this basis, this is a completely new Constitution, it is about writing a second Constitution of Kosovo, which applies only to Serbs." - he said about the draft of the Association.
