The Belgrade court has remanded former KLA member Avni Qenaj in prison for 30 days.
This decision was confirmed by his defense lawyer, Xhevdet Smakiqi.
Smakić considered the decision an unlawful deprivation of liberty and criticized the lack of effective diplomatic pressure from the Kosovo Government.
" In the absence of a serious Kosovo government, kidnappings of former KLA members continue because Serbia easily violates the Brussels agreements, which guarantee freedom of movement and fundamental rights, while not applying them to former KLA members ," he wrote.
The lawyer stressed that Qenaj was held in detention without a single piece of evidence, while effective diplomatic pressure from Pristina would have allowed his release.
He added that Qenaj's family is alone, struggling alone to protect the arrestee's legal rights and freedom of movement.
" Qenaj's family is spending these national holidays in anxiety, without state support, and is forced to fight on its own through private engagement with its lawyers, " Smakiqi stressed.
He concluded the post by expressing confidence that Avni Qenaj's innocence will triumph, but criticizing the failure of the state and government of Kosovo to fulfill its responsibilities.
“ Freedom for Avni Qenaj and happy November 28 in the Belgrade cell, where he is being held hostage in violation of international conventions, ” he wrote.
