150 thousand trials blocked! Giant backlog, law change required to introduce

The stock of files is not decreasing, as so far the number of pending cases has reached 150,000 nationwide.

For this reason, justice stakeholders have proposed to intervene again in the law "On the Organization of the Judicial Power" approved by the justice reform in 2016.

The legal assistant attached to the judicial bodies is seen as the key to the solution, and for this, the recent implementation of the American project in the Supreme Court that piloted the addition of legal advisors is cited as an example, leading to the evasion of court cases in the backlog.

In this proposal to make legal changes, which suggests that the number of legal assistants be double the number of judges at the national level, it is mentioned that the intervention is not carried out solely due to the volume of backlogged cases and judicial delays.

In fact, it is mentioned in the report that the vetting process simply accelerated the backlog of files, as this situation had been observed before. Therefore, it is emphasized that the High Judicial Council considers the changes in legislation as necessary to improve the good administration of the courts.

Currently, the number of legal advisors is 56, while the approved number of judges is 408. The lack of legal assistants has a negative impact on each judge who prepares and resolves the case. If each judge is assisted by a legal assistant, the speed of the trial will increase significantly, it is further predicted.

Another suggestion is to change the recruitment scheme for legal advisors, which currently requires competition at the magistrate's school and which is proposed to be carried out through court councils./TCH
