After being kept in the drawer for months, without issuing by-laws or decisions regarding the legalization of the cultivation of cannabis for medical purposes, when the election day approaches, the Government approves the decision that defines the rules. It now remains for the public to learn who the licensed entities will be and where they will exercise their activity at one of the upcoming meetings.
On the eve of the May 11 elections, the Government has approved a decision related to the areas for the cultivation and processing of cannabis for medical purposes.
At a time when he is distributing bonuses to pensioners twice within 6 months, when he announced the reduction in the price of energy, when payments for concessions continue, it seems that the Prime Minister has thought that the financial hole that can be created in the budget will be filled with cannabis .
But not only that, being on the eve of the elections, the licensing of companies in this industry, which is applied for the first time in Albania, can be used precisely in function of the election process.
The decision approved today by the Government defines the standards of the safety plan and elements of protection for the surface for the cultivation and processing of the cannabis plant for medical purposes and the rules for the movement of vehicles dedicated to the transport of raw materials and products, which licensed entities must complete.

Details from the Decision
According to the decision, the licensed entity in the premises where the activity is carried out must meet the following standards:
a) The premises must be continuously monitored with a CCTV camera system, equipped with a built-in reader and motion sensors, with a high resolution of at least 1280 x 720, with infrared rays, including the space of 20 meters outside the enclosure , which should be lit. Film images of the camera system must be stored for at least 90 days in the NRV/Server and at least for a period of 1 year in "Cloud" memory located in one of the EU countries;
b) The CCTV camera system monitors the surface, inside and outside the premises of the production unit, being oriented in order to ensure clear and safe identification of the premises and of all individuals who access or move inside them or outside near the fence;
c) Përdorimi i pajisjeve elektronike të teknologjisë së lartë, në funksion të sigurisë (detektorë, ura kontrolli);
ç) Në varësi të vlerësimit të rrezikut dhe në bashkëpunim me strukturat e Policisë së Shtetit, lidhja e sinjalit të alarmit, në nivel qendror dhe/ose vendor, me sallat e komandimit/informacionit të Policisë së Shtetit;
d) Sipërfaqja ku ushtrohet aktiviteti ruhet 24 orë pa ndërprerje nga subjekti i ngarkuar për ruajtjen dhe sigurinë fizike që përfshin dhe shërbim reagimi me grup verifikimi sinjalesh;
dh) Për rastet kur kultivimi kryhet në ambiente të hapura ose të mbrojtura rrethohet nga jashtë me mur betoni të qëndrueshëm me trashësi të paktën 25 (njëzet e pesë) cm dhe lartësi 4 m nga toka, mbi të cilin vendoset tel me gjemba;
e) Për rastet kur kultivimi kryhet në ambiente të mbyllura, muri i jashtëm i godinës duhet të jetë mur betoni i qëndrueshëm me trashësi të paktën 25 cm;
ë) Hyrja në ambientet e njësisë është e kufizuar dhe mundësohet përmes një porte hekuri që garanton aksesin vetëm për personat dhe mjetet e autorizuara, si dhe monitorohet nga sistemi i kamerave ÇTV, të përcaktuara në shkronjën “a” të kësaj pike;
f) Porta e hyrjes kontrollohet nga personel i autorizuar për sigurinë, i cili mban evidencë për çdo hyrje-dalje të personave, automjeteve dhe mallrave;
g) Materialet teknike, të cilat garantojnë sigurinë dhe monitorimin, vendosen në një dhomë të veçantë të dedikuar brenda perimetrit të sipërfaqes ku ushtrohet aktiviteti, në të cilën ka akses vetëm personeli përgjegjës për sigurinë.
Gjithashtu përcaktohen rregullat që duhet të ndiqen nga subjekti i licencuar për lidhjen e marrëveshjes për ruajtjen dhe sigurinë fizike, si dhe lëvizjen e automjeteve të dedikuara të tregtimit të lëndëve të para dhe produkteve janë, si më poshtë vijon:
a) Transporti i bimës, nënprodukteve dhe produkteve të saj duhet të kryhet me mjete të mbyllura që sigurojnë që ato të mos jenë të dukshme ose të identifikueshme nga jashtë automjetit dhe duhet të shoqërohen me procesverbalin përkatës për sasinë dhe llojin e produktit që transportohet.
b) Transporti i bimës, nënprodukteve dhe produkteve të saj të destinuara për përdorim mjekësor, të prodhuara nga bima e cannabis-it nga prodhuesi i licencuar, duhet të bëhet me mjete transporti të tilla që të sigurojnë ruajtjen e barit në temperatura as më të larta e as më të ulëta sesa ajo që thuhet në etiketim ose fletudhëzuesin e barit.
c) Subjekti i licencuar duhet të sigurojë që automjeti i transportit të jetë i mbyllur, i vulosur dhe i pajisur me GPS, me qëllim monitorimin pa ndërprerje të lëvizjes nga origjina në destinacion dhe të ketë kamera që monitorojnë materialin që transportohet, si dhe të ruhet dhe të shoqërohet nga shërbim i sigurisë deri në/nga pika e kalimit të kufirit sipas parashikimeve në marrëveshjen e lidhur mes palëve.
ç) Any movement or transport is carried out only after receiving authorization from the Agency, which approves the proposed date of movement or transport, according to the format approved by the latter.
d) In any case, for any movement, transportation of seeds, seedlings, raw material, medical cannabis plant, its by-products and final products and waste/products that are disposed of from one country to another, the subject of licensee is obliged to notify, at least 5 (five) days before the planned movement, through the National Register of licensed and permitted activities of the cannabis plant and the General Directorate of Police of the State. The notification contains information related to the movement schedules, the relevant schedule, the data for each vehicle that makes the transport, as well as the service employees accompanying the load.
dh) The licensed entity guarantees the Agency unlimited and real-time access to the camera system that monitors all premises of the unit, as well as the camera system that monitors the transport of any material related to medical cannabis, as well as to the images saved footage.
e) Export customs procedures can be carried out at the border customs offices of exit from the customs territory of the Republic of Albania, where security and protection checks are also carried out and, as the case may be, these procedures can be started at the internal customs offices competent for the territory where the cultivation premises are established and to be completed at the border customs offices of the exit from the territory, in accordance with the customs legislation that regulates the procedures for the export of goods.
