Former prosecutor Eugen Beci has spoken about the "prison arrest" measure, which he called excessive, as it is being set when it is not necessary.
According to Beci, the ECtHR also showed this with the decision on the case of 'Hysa', an official who was detained in prison without right under the charge of abuse of office.
The former prosecutor said that this measure should be at the last level of the security measure that can be taken.
"The decision of the ECtHR in the Hysaj case is typical of the difficulties that citizens are facing with the Albanian judiciary, where the security measure "prison arrest" has become like bread and cheese. Such a measure is granted only if all other measures are inadequate. "Albanian authorities, both for 0.1 gram and for 10 kg, give prison terms, they do not categorize at all", said Beci in "Report TV".
Beci says that prison arrest is the last resort of a security measure, since the ECHR itself has called it inappropriate. According to him, the Hysaj case is an alarm bell for Albanian law enforcement bodies.
"Prison is the last extreme of a security measure. The ECHR itself has called the way of isolating a citizen unjust. This is a reference decision for our institutions. It is binding for the Hysa case but it is an alarm bell for the Albanian law enforcement bodies that must they understand that prison arrest is not the right way" , concluded Beci.
