SPAK has not approved the Municipal Council's request for Erion Veliaj to physically participate in the meeting to be held tomorrow where the 2026 budget will be discussed. In the request, the Council also requested online presence and it is not known whether the Special Prosecution Office has approved the latter.
The request signed by 22 socialist members stated that the participation of the Mayor is a functional right guaranteed by law, necessary for the presentation of drafts, budgets, annual reports and administration issues of the local self-government unit.
This request came after the Constitutional Court overturned the government's decision and left Veliaj in office as mayor of Tirana.
Letter from the Tirana Municipal Council to SPAK and the Prisons Directorate:
Honorable representatives of the institutions,
The Tirana Municipal Council, in compliance with its legal obligations and in order to guarantee the regular institutional functioning, is addressing you to request the participation of the Mayor of Tirana, Mr. Erion Veliaj, in the next meeting of the Municipal Council, which will take place on Friday, 21/11/2025, at 10:00 am in the premises of the Tirana Municipality.
According to Law No. 139/2015 "On Local Self-Government", specifically:
Article 58, point 4, stipulates that the Mayor has the right to participate in the meetings of the Municipal Council and to report.
Article 60 establishes mandatory cooperation between the Mayor and the Municipal Council on matters of public interest.
Given that the participation of the Mayor is a functional right guaranteed by law, necessary for the presentation of drafts, budgets, annual reports and administration issues of the local self-government unit, we ask that, if restrictive measures are being applied to him, it be assessed:
– temporary permission for physical participation,
or, if this is not possible,
– enabling his participation through an appropriate communication modality (online, videoconference or other approved form).
The Municipal Council is ready to fully cooperate with any security, protocol or logistical requests of your institutions, in order to guarantee a legal, transparent and functional process.
Please inform us in writing of your decision-making, considering the importance of respecting the institutional functions and the right of the Mayor to report to the City Council.
