
The Assembly of Greek Chambers of Advocacy, during today's conference, has declared that the arrest and continued detention of the elected mayor of Himarë Municipality, Fredi Beleri, is a violation of Article 3 of Protocol No. 1 of the European Convention on Human Rights.
Article 3 of Protocol No. 1 gives the right to an individual to appear as a candidate in the elections and if elected to exercise his mandate effectively.

In the case of Beler, the right to effectively exercise his mandate was violated due to the measure of detention. The job of an elected representative is to represent his electorate, draw attention to their concerns and protect their interests. This is even more the case if the accusations against that representative have a political basis.
The measure of detention imposed on Beler both by the Court of First Instance of Vlora and by the SPAK courts of Tirana is extremely severe, if not arbitrary, because the disputed measure aims to prevent the applicant from exercising his mandate as chairman of Chosen of Himara.
The Albanian government is obliged to consider less harsh measures to protect Beler's right to exercise his duties as the elected mayor of Himarë Municipality. Consequently, there is a violation of Article 3 of Protocol No. 1.
Violation of Article 10 of the European Convention on Human Rights
Beler's ban, as well as the refusal by Albanian courts to allow him to participate in City Council meetings and perform his duties, violates his right to political expression. This happens because it deprives him of the opportunity to effectively represent his voters and contradicts the integrity and effectiveness of the electoral procedure of May 14, 2023, ultimately undermining its goal, that is, the identification and materialization of the will of the people. As a result, there is a violation of Article 10 of the Convention.
Violation of Article 6-2 of the European Convention on Human Rights
The repeated comments and remarks made by the Prime Minister, his one-sided negative assessment of the Beleri case and the use of blunt and careless language affect the public opinion regarding the guilt of Beleri and prejudice the future decision of the Court.
Prime Minister Edi Rama's statements went beyond a simple disagreement with a political opponent. To create the impression that the prime minister expressed his satisfaction with the arrest and continued detention of Beler. The Prime Minister embodies, par excellence, the political authority responsible for the organization and proper functioning of justice in Albania.

Edi Rama të lejojë Belerin të bëjë betimin si kryetar i zgjedhur
Kryeministri shqiptar Edi Rama ka pohuar vazhdimisht se “autoritetet e pavarura gjyqësore” po e pengojnë Belerin të dalë nga burgu për të bërë betimin si kryebashkiak i Himarës.
Në fakt nuk ka asnjë vendim gjykatë që e ndalon Belerin të bëjë betimin. Përkundrazi, në aktgjykimin numër 226 të datës 26 qershor 2023, nga Gjykata Speciale e Shkallës së Parë për Korrupsionin dhe Krimin e Organizuar, e cila shqyrtoi kërkesën time për leje për të bërë betimin si kryetar bashkie, shprehimisht thuhet se:
“Gjykata konstaton se…nuk është autoriteti kompetent dhe se i mungon juridiksioni për të vendosur për miratimin e lejes së kërkuar nga individi nën hetim”.
The competent authorities for granting this permit are (a) the Director of the Institution of Execution of Criminal Sentences, where he currently resides and (b) the General Directorate of Prisons. These entities are simple administrative units and not "independent judicial authorities".
The Albanian Prime Minister must give the necessary authorization to his subordinates, namely the Director of the Institution of Execution of Criminal Sentences of Durrës prison, or the General Directorate of Prisons, allowing them to facilitate the transport of Beler to Himara, accompanied by police officers, in order to take the oath of office.
