Two SPAK prosecutors, Dritan Prençi and Dorina Bejko, have arrived at the Constitutional Court for the case of Deputy Prime Minister Belinda Balluku.
Meanwhile, government representatives have also arrived. The session will begin at 10:00.
The government representative will be Herald Jonuzaj.
The president's institution will be represented by advisor Ilir Rusmali, chief of staff Hermioni Braho, and Director General Eriola Shia.
The Assembly will have as its representative the legal director, Mimoza Arbi.
Meanwhile, the Special Court against Corruption and Organized Crime (SCOC) has announced that it will not participate in the public session taking place this Thursday at the Constitutional Court, following Prime Minister Edi Rama's appeal to resolve the conflict of competences regarding the suspension of Deputy Prime Minister Belinda Balluku's duties as a member of the Council of Ministers.
In a press release, the GJKKO argues this decision by saying that a court cannot be summoned or legitimized as a party to the process in a constitutional trial, as this would violate the principle of separation of powers and the internal independence of the judiciary.
"We inform you that the Constitutional Court will not participate in this plenary session as it considers that it cannot be legitimized as a party in the constitutional trial with the Prime Minister of the Republic of Albania as the applicant."
In a democratic state of law, based on the principle of the rule of law and the separation of powers, a court cannot be summoned or legitimized as a party in a constitutional trial to make submissions or to defend a decision given by it. The participation of the GJKKO as an interested party in the Constitutional Court would violate the principle of the separation of powers and the internal independence of the judiciary.
