The Special Court held the next session of the trial in absentia against former Deputy Prime Minister Arben Ahmetaj in the case known as "Buka". Ahmetaj is accused of the criminal offense of abuse of office.
During the hearing, there were debates between the defense attorney of the former senior official and the SPAK prosecutor. Also present in the courtroom were the injured parties from the criminal offense, representatives of the Myderizi family.
Ahmetaj's lawyer, Henrik Ligori, filed a request for the seizure of evidence in connection with the "Buka" SHA case. According to him, Ahmetaj does not accept the accusation, declares his innocence and considers it political. The defense requested that Ahmetaj be questioned via videoconference, that written evidence be administered, that the experts who conducted the technical and accounting expertise be questioned, and that the former Minister of Finance Shkëlqim Cani and other officials of this institution be called as witnesses. It was also requested that all legal acts related to "Buka" SHA and relevant documentation be seized.
The court asked the SPAK prosecutor to explain Arben Ahmetaj's actions and inactions, which, according to the indictment, constitute abuse of office.
SPAK prosecutor Elvin Gokaj stated that the file contains court decisions that have given the Myderizi family the right. He emphasized that Ahmetaj acted through an order, appointing two experts himself, while the expert report presents contradictions. According to the prosecutor, the privatization of the property was not carried out earlier by former ministers Nasip Naço and Florian Mima, while Ahmetaj violated the decision of the Constitutional Court, which has legal force.
On the other hand, the representative of the Myderizi family, Adrian Myderizi, said that the defense is trying to confuse the issue, emphasizing that it is a clear violation of duty. He stated that the Myderizi family has won the trial against the Ministry of Economy with a final decision and has opposed the method of calculating the owners' shares. According to him, the property has been valued much lower than the market price, creating room for abuse, while the family has been seeking the property through legal means for 30 years, despite having won the court proceedings.
In conclusion, the court decided to postpone the hearing to January 27, to give the SPAK prosecutor time to express his opinion on the evidence and witnesses requested by Arben Ahmetaj's defense.
