
The lawyer Kreshnik Spahiu, analyzing the 'Partizani' case, explained the difference between the criminal file and the security measure.
In an interview for the show "Now" on "Euronews Albania" he said that the Parliament cannot stop the criminal proceedings against the former prime minister, but it can stop the security measures taken against him.
" For an essential, legal, constitutional, procedural matter, the Parliament of Albania does not give authorization to allow criminal proceedings or not, which means it gives permission only for the security measure. To make it more understandable in Albanian, the Parliament has refused the Prosecutor's Office to grant a security measure for Saimir Tahiri, but this did not prevent the Prosecutor's Office from investigating the case in a free state, taking it to court and sentencing Saimir Tahiri to prison, which will says that even if it were to go to the Parliament, if the Parliament voted to reject the obligation to present Sali Berisha, this would not prevent SPAK from continuing the criminal proceedings. So, the criminal file is another thing and the insurance measure is another thing ," explained Spahiu.
