Details and procedures on how to protect judges Doloreza Musabelliu and Merita Selimi, who are in danger from Laert Haxhiu's gang, are revealed. In special cases and at the request of the president of the Court against Corruption and Organized Crime or the head of the Special Prosecutor's Office, protection is provided for family members, apartments and/or escort for judges and prosecutors, "said in VKM . These provisions have been applied to Mrs. Musabelliu.
As for the prosecutor Selimi, even though she was dismissed from the veting in the first instance, she has the right to defend herself. This is guaranteed by the law "On the status of judges and prosecutors in the Republic of Albania" where Article 20 states:
"1. During the exercise of the function or because of it, the magistrate and his family enjoy the right to have special protection from the state for their life, health and property. The magistrate who does not exercise the function or who has retired enjoys this protection, in case he requests it, as well as in case of infringement due to the previous exercise of the function of the magistrate.
2. Në rast se jeta, shëndeti dhe pasuria e magjistratit ose familja e tij janë në rrezik, shteti ofron mbrojtje të veçantë, si dhe mbrojtje fizike, sipas kritereve dhe procedurave të përcaktuara me vendim të Këshillit të Ministrave, pas konsultimit me Këshillat.
3. Dëmet e shkaktuara për jetën, shëndetin ose pasurinë e magjistratit ose familjes së tij/saj, shpërblehen nga shteti, në rast se këto dëme shkaktohen gjatë ushtrimit të funksionit të magjistratit ose për shkak të tij”.
Ndërkohë në VKM theksohet: “1. Magjistratit i sigurohet mbrojtje e veçantë personale, e familjes dhe e pasurisë, sipas parashikimeve të këtij vendimi, kur, gjatë ushtrimit të funksionit ose për shkak të tij, i rrezikohet jeta, shëndeti i tij dhe/ose e/i familjes, si dhe pasuria. Mbrojtje e veçantë i sigurohet edhe magjistratit që nuk e ushtron funksionin ose që ka dalë në pension, në rast se e kërkon, në rast cenimi për shkak të ushtrimit të mëparshëm të funksionit.
2. Me mbrojtje të veçantë personale, të familjes dhe të pasurisë, sipas këtij vendimi, do të kuptohen masat me karakter organizativ e profesional, për sigurimin dhe ruajtjen e veçantë fizike, mbrojtjen e familjes e të pasurisë së magjistratit, si dhe masat e tjera, që lidhen me këtë mbrojtje”.
Sipas procedurës, ata merren në mbrojtje pas kërkesës që i bëhet komisionit që merret me të tilla raste, pro kur kërcënimi është imediat, atëherë policia e merr direkt në mbrojtje, sikundër ka vepruar në rastet e mësipërme.
“Kur rreziku ndaj magjistratit është serioz dhe i çastit, drejtori i Përgjithshëm i Policisë së Shtetit urdhëron strukturat e Policisë së Shtetit të marrin masa të menjëhershme për të garantuar jetën, familjen ose pasurinë e magjistratit, deri në mbledhjen e komisionit. Komisioni, pas shqyrtimit të kërkesës, vlerëson masat e marra nga strukturat e Policisë së Shtetit dhe vendos, kur është rasti, për vazhdimin e mëtejshëm të tyre”, theksohet në VKM.
