Referring to official documents from SPAK on electoral crimes, 110 criminal proceedings were registered in 3 years in the period 2021-2024. So what happened to SPAK's files, how many people have been prosecuted and how many cases have been closed?
According to official sources, 32 cases were transferred to prosecutors' offices of general jurisdiction, suggesting that a significant percentage of cases initially registered by the Special Prosecution Office were not within its jurisdiction.
Meanwhile, for 28.2% of cases, a lack of sufficient evidence was identified for a significant portion of cases. In this context, 31 cases were dismissed, mainly due to lack of evidence or the inability to identify the violators of the law.
This is an indication that in some cases, investigations have been hampered by the lack of cooperation of witnesses and the difficulty in securing evidentiary materials.
According to documents from SPAK, 22 cases are still under investigation, a figure that shows that the Special Prosecution Office is still working on a significant number of cases. But what SPAK emphasizes is the need for continuous human capacity building to accelerate and finalize investigations, maximizing the effectiveness of criminal prosecution in the context of election-related criminal offenses.
Of the total number of registered cases, only 14 cases have been sent for trial, suggesting that the percentage of investigations that end with charges being filed and sent to court is not within the expectations of the Special Prosecution Office.
This indicator is related to the difficulties encountered in collecting evidence, the lack of cooperation from witnesses, the complexity of the criminal offenses and subjects investigated by the Special Prosecution Office. /Pamphlet/
