Judge Elsa Ulliri, who will preside over the trial of former Prime Minister Sali Berisha and four other defendants, turns out to have a close family connection with one of the Democratic Party MPs. She is Andia Ulliri, who entered the Assembly after the 2021 elections.
Andia Ulliri also ran in the May 11 elections, on the open list of the Democratic Party in the Durrës district.
This situation raises questions about the possibility of a conflict of interest between Judge Elsa Ulliri, who will review one of the most important judicial processes in the country, and the former prime minister who currently leads the Democratic Party, which also includes Andia Ulliri - a close associate of the judge.
Can a relative of a Democratic MP judge her political boss?
Lawyer Jordan Daci, invited to the "Real Story" show on ABC News, stated that there is not enough evidence to prove bias in the judicial process against Sali Berisha:
" Formally, there is no conflict of interest. On the other hand, to determine whether there is a conflict or not, there is a test that the prosecution can request. In each case, the test will be carried out, where we must have objective indicators first and then subjective indicators. At the moment, if we take the objective indicators, if her cousin is a deputy, it does not indicate that there is a conflict of interest. It does not indicate that there is bias. In this specific case, it is a very weak indicator for the Strasbourg test ," he said.
The issue remains delicate, while public opinion and the opposition will closely follow the development of this process and any decision-making that may be affected by the perception of a conflict of interest.
