The Council of Mandates and Immunities approved today with 6 votes in favor and none against that the request of the Special Prosecutor's Office be passed to the Parliament for the removal of the mandate of deputy Sali Berisha.
Eugen Beci, the former prosecutor of Serious Crimes, said that the Council of Mandates acted deceitfully, not asking the Special Prosecutor's Office for the reasons for the request for the removal of Berisha's mandate.
"What happened today in the Parliament of Albania, as Alibeaj also said, is a routine procedural request. The Constitutional Court will later judge the request of 1/5 of the deputies, so the Council of Mandates developed a routine procedure.
The Constitutional Court can overturn everything, even today's decision of the Assembly, but it could not suspend it today.
The Special Prosecutor's Office has thought that the conditions for a citizen should be aggravated. Today it was requested to remove the immunity of a deputy. In the closest such case, that of Saimir Tahir, the Council of Mandates gave authorization to the Serious Crimes Prosecution to set an obligation to appear, the ban on going abroad and personal control, so we understand that the Parliament of Albania had the authorization to banned from leaving the country, and by analogy with today it seems to have been exceeded by the Special Prosecutor's Office.
Today, the Mandates Council bypassed by trick, because, if you go to the Assembly and say you want to limit or remove the immunity of a deputy, the law provides that you must go with a concrete relationship and tell them the reasons with evidence on which you base this request and you cannot use procedural tricks and say that we have nothing to do with the plot, but we have to do with this man whom I have assigned an obligation to appear and he has not appeared. It doesn't work like that, to go and ask for immunity to be waived and not say what he did. The law has clearly defined that when you turn to the parliament for the removal of immunity, you must accompany it with a relation with facts", said Beci in "TPZ".
