ILD demands the dismissal of judge Arta Llazari

The High Inspector of Justice requested the dismissal of Shkodra judge Arta Llazari for failing to initiate civil cases for years, as well as for repeatedly violating procedural deadlines for reasoning judicial decisions. Llazari claimed that she had a very high workload and presented evidence to support her claims.

The High Judicial Council, KLGJ, was informed on Wednesday, March 5, of the final conclusions in the disciplinary case initiated against Shkodra judge, Arta Llazari. Representatives of the High Inspector of Justice, ILD, stood by their requests for the dismissal of judge Llazari for very serious violations, while the subject presented her defense and objections.

The ILD initiated a disciplinary investigation against Judge Llazari based on 11 complaints for failure to properly perform her duties, and violation of civil and criminal procedural deadlines. According to the ILD, other facts were also identified during the administrative investigation, specifically violation of civil and criminal procedural deadlines for the reasoning of the court decision, as well as failure to initiate civil cases, exceeding the deadlines beyond any logic and in a continuous manner. This situation, according to the ILD, is almost equivalent to a lack of justice.

During the investigation, the ILD found many cases where, from the moment the cases were registered and assigned to Judge Llazari, no action was taken for a period of over 3 years. According to the ILD, the actions of the magistrate were carried out at least with carelessness in the form of negligence that was repeated and continuous, where in some cases they caused damage to the investigative procedures.

Given the fact that the judge has 24 years of experience, the ILD assesses that she has significantly damaged the image of justice and the public's trust in it. Assessing that Lazari is in conditions of a very serious disciplinary violation, it definitively requested her dismissal from office.

Judge Llazari claimed that she had a high workload. She also stated that she had presented new evidence before the hearing, claiming that it supported her submissions.

The Supreme Court took until April 2 to announce its decision, noting that the materials filed by the parties are voluminous.

Judge Arta Llazari was confirmed in office by the Independent Qualification Commission on February 13, 2023, while two cases judged by her were sent for further verification to the High Inspector of Justice. During the hearing, she gave

explanations about the sources that had served to create her assets and those of the parents with whom she lives, as well as about transactions of certain monetary values ​​by her parents, which she declared belonged to her brother.

Arta Llazari graduated from the Magistrates' School in 2001 and has been practicing law at the Shkodra District Court for more than two decades. She has also worked as a legal advisor at the Constitutional Court. / BIRN
