
The Criminal Court of Appeal will announce the verdict for the defendants in the Tirana incinerator case on April 16.
In this process, among the accused is the former Minister of Environment, Lefter Koka, who faces charges of corruption, abuse of office and money laundering, related to contracts and public funds involved in the construction and management of incinerators in several cities.
The investigations were conducted by the Special Prosecution Office (SPAK), which has presented evidence of the involvement of Koka and several other officials in corruption schemes that are suspected of having caused millions of euros in damage to the state budget.
SPAK has requested a 4-year prison sentence for former Minister Koka, who is being tried in a summary trial along with 7 other defendants.
SPAK has also requested the following sentences for the defendants:
Bledar Karoli 4 years in prison
Fatjon Murati 4 years in prison
Taulant Tushe 4 years in prison
Namik Simixhi 4 years in prison
Valbona Ballgjini 2 years in prison, 4 years probation
Sidita Kopliku 2 years in prison, 4 years probation
Jetmir Llapaj 2 years in prison
For the Fier incinerator, former Minister of Environment, Lefter Koka, was sentenced to 10 years in prison, but due to the shortened trial, his sentence was reduced to 6.8 years behind bars. For the Elbasan incinerator, former Minister Koka was sentenced to 10 years in prison, but due to the shortened trial, he will serve 6.8 years in prison for this case as well.
SPAK for the Tirana incinerator
According to SPAK, from the administered acts of the contract concluded between the Contracting Authority, the Ministry of Environment, and the company "Integrated Energy BV SPV" sh.pk, with an investment cost foreseen by the concessionaire company in the amount of 128,248,330 Euros (one hundred and twenty-eight million, two hundred and forty-eight thousand, three hundred and thirty) excluding VAT, illegal actions committed due to the duty of the defendants have been ascertained.
Illegal actions were found in relation to the proposal for granting a bonus to the proposing company "Integrated Energy BV", the members of the Concession Award Commission, composed of the defendants Valbona Ballgjini, Pëllumb Abeshi, Erjon Murataj, Sidita Kopliku, Etleva Kondi, Taulant Tusha, Namik Simixhiu, in collaboration with the former Minister of Environment, the defendant Lefter Koka, Alba Thoma, Director of the Legal Directorate of the Ministry of Environment, Bledar Karoli, Head of the Procurement Sector at the Ministry of Environment.
According to the investigation body, it turns out that the members of the Commission proposed the award of the bonus without drafting a summary report, and when the proposal for the award of the bonus was made, the concession award commission had not yet clarified the costs of the project. On the part of the officials of the Contracting Authority, the Minister of Environment, Lefter Koka, the Legal Director of the Ministry of Environment, Alba Thoma, the Head of the Procurement Sector at the Ministry of Environment, Bledar Karoli, a draft decision was prepared and then sent to the Council of Ministers, for the award of a bonus of 8% of the total points of the competition to the proposing company.
Regarding the concession award procedure, it appears that the proposing company "Integrated Energy BV" (in which citizen Klodian Zoto's company, "Integrated Technology Services" sh.pk) is also a shareholder) was aware of the competitive circumstances before the procedure was announced.
According to SPAK, this happened thanks to the assistance provided by the officials of the Ministry of Environment themselves, Lefter Koka, former Minister of Environment, Alba Thoma, Director of the Legal Directorate, Bledar Karoli, Head of the Procurement Sector, as well as by the members of the concession award committee, Valbona Ballgjini, Pëllumb Abeshi, Erjon Murataj, Sidita Kopliku, Etleva Kondi, Taulant Tusha, Namik Simixhiu, where the proposing company "Integrated Energy BV" was provided with the necessary documentation that it had to submit to the Ministry of Environment before and during the concession procedure, in order to declare this company the winner.
Whereas, in relation to the drafting and approval of the standard concession documents, the members of the concession award committee, Valbona Ballgjini, Pëllumb Abeshi, Erjon Murataj, Sidita Kopliku, Etleva Kondi, Taulant Tusha, Namik Simixhiu, in collaboration with the head of the Contracting Authority, Lefter Koka, former Minister of Environment, have acted in violation of the law "On the approval of the rules for the evaluation and award of concessions, public private partnership", as amended.
In relation to the feasibility study, the members of the concession award committee, Valbona Ballgjini, Pëllumb Abeshi, Erjon Murataj, Sidita Kopliku, Etleva Kondi, Taulant Tusha, Namik Simixhiu, have acted contrary to the law regarding the cost calculations in the feasibility study, by taking the costs from the feasibility study of the proposing company "Integrated Energy BV", without conducting any verification regarding their authenticity.
According to SPAK, the administered acts result in fictitious data included in the feasibility study, which have fictitiously increased the waste disposal fee by Local Government Units, 29 Euros/ton.
