Former mayor of Kavaja, Elvis Roshi, has been summoned to SPAK.   

His call comes after the Special Court ordered SPAK to continue investigations into the former mayor of Kavaja, who was removed from office due to the decriminalization law.

Roshi's summons to SPAK is related to a report by the High Council of State, during the 2013-2014 audit, when Roshi was the mayor of Kavaja. In this audit, several irregularities were found in the field of Urban Planning and procurement of public funds with economic damage worth 33 million lek.

The Special Prosecution Office is conducting investigations into suspicions regarding abuses with public tenders in the municipality of Kavaja at the time when this institution was headed by Roshi, and the latter was questioned in his capacity as a person who has knowledge of the circumstances of the investigation as the former head of the public institution.

The Durrës Court had previously dismissed the criminal proceedings against the former socialist mayor. However, the Special Court has decided to transfer the case of the former mayor of Kavaja, Elvis Roshi, accused of abuse of office, to the Special Prosecution Office.

In 2015, the then mayor of Kavaja was reported to the Prosecutor's Office by the Supreme State Audit for legal violations with the procurement of public funds.

According to the Albanian Supreme Audit Office, Rroshi and 10 other officials of the Kavaja municipality have caused economic damage of 33 million lek with the tenders for the reconstruction of the city center and the construction of several roads.

In an official announcement, the SAI stated that the violations were discovered after an audit conducted in the municipality of Kavaja for the period January 2013-December 2014, during which time Rroshi and his subordinates are accused of having committed the criminal offenses of "abuse of office" and "violation of equality of participation in tenders or public auctions."

The Supreme State Audit Office listed 12 tenders, mainly for the reconstruction of the city center, several connecting roads and the planting of decorative trees, on the list of violations. The Supreme State Audit Office accused the municipality of Kavaja of following a double standard in evaluating participants in several tenders, by disqualifying the operator with the lowest bid. For 3 other tenders, the Supreme State Audit Office assessed that the bidder with the lowest price was unfairly disqualified as a result of incorrect calculation of the bid.

According to the Albanian Supreme Audit Office, legal violations were also found in the purchase of fuel, planting decorative trees, or lighting the "Indrit Cara" promenade in Kavaja, where the winning companies are assessed to have been announced without meeting the legal criteria for qualification.

The tenders reported by the SAI were carried out during Elvis Rroshi's first term as mayor of Kavaja.

In addition to violations with public procurement, the Supreme Audit Office also found problems in the implementation of urban planning laws in the city of Kavaja during the audit. According to the Supreme Audit Office, interventions in infrastructure were carried out without completing the relevant technical and legal documentation in 20 cases.

After the report, no criminal charges were ever filed against Roshi.

Lying on the decriminalization form and the punishment for gang rape in Italy

Elvis Roshi came to the head of the Municipality of Kavaja in the 2011 local elections, under the logo of the Socialist Party, as a character strongly supported by Prime Minister Edi Rama.

In the 2015 elections, Roshi won a second term, presenting the transformation of the city through public works as a success.

The decline would begin a year later, when the CEC removed the mandate of Mayor Elvis Roshi, after verifications by the General Prosecutor's Office revealed that he had lied in his self-declaration on the decriminalization form.

The prosecution found that he had not reported a gang rape conviction received in Italy.

Verifications conducted by the Italian liaison office with Europol revealed that Ervin Roshi was convicted of rape committed in 1995 in Campobasso, Italy. At the time, he was 16 years old and had gone to the neighboring country as a refugee.

Investigations also revealed that he had been deported from Switzerland in 1993 and 1997. Referring to medical reports, the detentions were related to drug trafficking issues.

For failing to declare these facts, Rroshi was arrested by order of the prosecution in June of that year under the charge of the criminal offense of "Forgery of seals, stamps and forms."

The measure against him was mitigated by the court and Roshi was later released, while he was finally sentenced in 2018 by the Tirana Court to 60 hours of community service.

During this time, Elvis Roshi returned to the center of opposition accusations, while support from Prime Minister Edi Rama was fervent. Even in May 2016, when he first commented on Roshi's resignation as mayor after his convictions abroad were revealed, Rama would state that Roshi was "being attacked with criminalizing opinions unsupported by facts and slander" and according to him "deserved solidarity".
