
The Supreme Court clarified the decision of two days ago, where it decided to examine in an open court session the case of the tragedy of January 21, 2011.
Today, the high court announced the hearing for the families of the victims of January 21 and Rajmonda Nika as appellant. The plaintiff is the wife of Aleks Nika
The reason is the court's attempt to unify the practice.
"After listening to the report of judge Sokol Binaj and discussing the case as a whole, the College considered it necessary to hear the parties because the case represents importance from the point of view of law, for the unification or development of judicial practice" - it is stated in the two-page decision of judges Sokol Binaj, Ilir Panda and Sandër Simoni.
This decision of the senior judges means that the parties will be called and in a session that is expected to be in front of each of them in two weeks, reports journalist Anila Hoxha. But the relatives of Aleks Nika, for whose murder for 13 years there is no news from the investigations of the capital's prosecutor's office, said that SPAK should focus on investigations also against the former Minister of the Interior Lulzim Basha, the former Prime Minister Sali Berisha and the former commander of the guard, Ndrea Prendi.
This attitude of the Nika family, but also of the relatives of the other three killed on the boulevard, Hekuran Dedas, Ziver Veizit and Faik Myrtaj, was not accepted by SPAK with the conclusion that the case was being investigated by the Prosecutor's Office of Tirana. In November 2023, the Strasbourg Court announced the next decision for Alex Nika, finding the failure to investigate and solve his murder to be a violation. For years, the Tirana prosecutor's office has opened and suspended several times the investigation into two murders, that of Hekuran Deda and Aleks Nika, but the results have only been in the context of the government's accusations against the capital's prosecutors. And on the other hand, a regressive attitude from the prosecution body of Tirana, which recently insisted that it is conducting investigations.
However, apart from the conviction of Ndrea Prendi and Agim Llupo for the murder of Faik Myrtaj and Ziver Veiz, the fact is that justice in Albania for more than a decade has failed to find who killed Hekuran Deda and Aleks Nika. Who will investigate January 21, SPAK or the Prosecutor's Office of Tirana, this will be understood after the court hears the parties in the session.
