
The Special Court has released from the cell the former head of IKMT Saranda, Julian Preni and the former employee of the Saranda Urban Planning Office, Arjel Balani, who were convicted of corruption and illegal influence for a beach permit and in the procedure followed for the demolition of a building on the coast.
GJKKO sentenced Balani and Preni to 1.4 years in prison in June of this year, after they were accused of demanding bribes from the citizen, Foti Doda, in connection with an object built on the beach of Ksamil.
Arjel Balani asked Foti Doda and Sofia Doda for an amount of 12,000 Euros, in order to exert illegal influence on the National Coastal Agency, with the aim of issuing the permission to use the beach.
In July 2021, Arjel Balani took 6,000 Euros from these citizens, talking that the rest would be given to him when the permit was issued, but later the agreement was not fulfilled and he returned the monetary amount .
While Julian Preni in March 2020, acting at that time - head of IKMT, Sarandë branch, asked Foti Doda for 7,500 Euros, in order not to destroy the building he had built on Ksamil beach.
After negotiating, Foti Doda gave Julian the sum of 3000 Euros. As a result of this corrupt action, Foti Doda's building was not demolished in 2020, even though there was a demolition decision by the IKMT since September 2019. From the documentation administered by the IKMT, it appears that the object of the citizen Foti Doda is broken only on 07.06.2021.

The petitioners Arjel Balani and Julian Preni on 13.09.2024 submitted to the Court the request with the object: "Determining the extinguishment of the measure of personal insurance "arrest in prison" imposed on the defendants Arjel Balani and Julian Preni by decision no. 115, date 25.10.2023, of the Special Court of First Instance for Corruption and Organized Crime and ordering the release of the defendants".
At the end of the trial, the Special Court of First Instance for Corruption and Organized Crime with a panel composed of judges Erjon Çela, Etleva Deda and Erjon Bani based on articles 112 and 261/1/c of the Penal Code, with decision No. 525, dated 15.09.2024, decided:
Accepting the request of the petitioners (defendants) Arjel Balani and Julian Preni.
Finding the cancellation of the personal security measure "prison arrest" assigned to the defendant Arjel Balani by decision no. 115 Act dated 25.10.2023 of the Special Court of First Instance for Corruption and Organized Crime, because the duration of the detention served is greater than the amount of punishment determined by decision no. 40 dt. 26.06.2024, of the Special Court of First Instance for Corruption and Organized Crime.
The immediate release of the defendant Arjel Balani from the personal security measure "prison arrest" is ordered, if no other coercive personal security measure "prison arrest" or final form of prison sentence is held.
Finding the cancellation of the personal security measure "prison arrest" assigned to the defendant Julian Preni by decision no. 115 Act dt 25.10.2023 of the Special Court of First Instance for Corruption and Organized Crime, because the duration of the detention served is greater than the amount of punishment determined by decision no. 40 dt. 26.06.2024, of the Special Court of First Instance for Corruption and Organized Crime.
The immediate release of the defendant Julian Preni from the personal security measure "prison arrest" is ordered, if no other coercive personal security measure "prison arrest" or final form of prison sentence is held.
The Special Prosecutor's Office against Corruption and Organized Crime as well as the judicial police are ordered to implement this decision.
An appeal can be made against this decision within 5 (five) days in the Special Court of Appeal for Corruption and Organized Crime, which period starts from the day after the notification of the court's decision.
