Gjoka's lawyers claim that the files coming from France and Belgium should not serve as evidence.

But the Constitutionalist will be faced with two difficult choices: Will she take the side of crime, or will she follow the path of Strasbourg.

On October 17, the Strasbourg Court has declared legal the interception by the 'EncroChat' application, which has been used mainly by people involved in the world of crime. In many other countries as well, wiretapping has been deemed legal and the Constitutional Court is facing a big challenge.

Rama's strategic investor, Pëllumb Gjoka, opposes the way in which the documents made available by the Belgian and French authorities were withdrawn from SPAK.

SPAK, on ​​the other hand, demands that the Constitutional Court dismiss the appeal, leaving in force the measures given by the GJKKO and the Appeal of the GJKKO, which it considers legal evidence.

The group of persons arrested in July during the "Metamorfoza" operation, including Pëllumb Gjoka, is suspected of a large number of criminal offenses, from "Premeditated murder", "Passive corruption of judges, prosecutors and other officials of the bodies of justice", "Active corruption of the judge, prosecutor and other justice officials", "Illegal deprivation of liberty", "Abuse of duty", etc.

But many others are waiting for the decision with interest, since if his request is accepted, a precedent will be set for others.
