Former prosecutor Eugen Beci spoke about the court session at the GJKKO that was held today in the case of Ilir Meta. He explains that Albanian legislation does not oblige the defendant to remain in a cage during the trial. According to him, placing the defendant in a cage conflicts with three rights that belong to the defendant.

" Albanian law does not oblige anyone to have the defendant remain in a cage during the trial, it is not provided for in any part of the criminal procedure code or in the Constitution. On the contrary, referring to the Constitution, the code and the principles of a fair, impartial and objective trial, we take into account three elements that limit the cage: the presumption of innocence, the dignity of the person and the right to a fair legal process.

"As for the presumption of innocence, the cage in concept and in public creates the idea that you are already punished. In all the arrests of high-ranking officials, the biggest request of journalists is to capture a photo in the cage and this is the dignity of the person ," he said for the "Now" show on "EuronewsAlbania".

Further, Beçi argues that the cage prevents normal communication between the defendant and the lawyer, violating due process.

" The right to a fair trial, this seems very general, but this is violated because it implies a very normal access that you should have with your defense attorney. When the client is in a cage, the lawyer is hindered. The cage is an exception to the rule. The cage can be determined by the court with full arguments such as the dangerousness of the person or that of the trial", emphasized former prosecutor Beçi.

Beçi added that the appearance of former President Ilir Meta in the courtroom today shows the state of Albanian prisons today and how Albanian prisoners are treated. According to him, there is an inhumane treatment of detainees in Albania, which has been repeatedly pointed out by all organizations that protect the rights of prisoners, from the Helsinki Committee to the Council of Europe.

" This treatment shows the state of Albanian prisons today. The state of prisons in Albania has been criticized by every organization that deals with the rights of prisoners and detainees. There are also exceptions that have never been proven, where the Directorate of Prisons treats some prisoners differently and this one differently.

"We have inhumane treatment for all detainees, there is overcrowding, violations of freedoms and human rights, which in this specific case are not tolerated by the former president. The Ombudsman has initiated administrative investigations several times for violations of these treatments against the former president and for restrictions on the rights of detainees in Albania ," said Beçi.
