The Special Court against Corruption and Organized Crime decided today to replace the measure of security by compulsory house arrest under police supervision against former Prime Minister Sali Berisha, a person under investigation for the privatization of the former Partizani sports complex.
The decision was taken by judge Irena Gjoka, president of this court, for which Mr. Berisha's lawyers had asked to be excluded from the judging panel, claiming a conflict of interest.
The Special Prosecutor's Office against Corruption and Organized Crime requested an authorization from the Assembly to strengthen the security measure against Mr. Berisha, because he refused to comply with the first measure, calling it unconstitutional, for several weeks in a row.
The Special Court ordered MP Berisha not to leave his apartment and not to communicate with other people except those who live with him in the same apartment, while for the implementation of this measure it charged SPAK and judicial police services.
According to the procedures, police supervision foresees regular services near Mr. Berisha's apartment to follow his compliance with this measure.
Mr. Berisha's lawyers said that this decision will be further appealed within the legal deadline, but the communication restrictions for a deputy are, according to them, illegal, because they had to be done with an authorization from the Assembly.
The former prime minister under investigation, Sali Berisha, is suspected of passive corruption in cooperation with regard to the issue of the privatization procedures of the former Partizani sports complex, during which SPAK suspects that he has exerted influence and pressure with various acts, favoring the son-in-law his Jamarbër Malltezi, one of the owners of that land, which was quickly filled with a group of buildings.
