
The amount of ammunition ordered to be delivered for dismantling in Gërdec was greater than the amount of ammunition categorized for dismantling. The amount of ammunition categorized for sale for dismantling by decision no. 7 dated 1.11.2007 of the Special Commission for Categorization according to link no. 2 attached to this decision (23-152 mm caliber additions) is greater than the amount of ammunition removed from use pursuant to VKM no. 617 dated 04.12.2002.
By comparing the quantities and types of ammunition categorized with decisions .1 dated 04.04.2007 and no. 7 dated 01.11.2007 of the Commission of Categorization, with the quantities of ammunition for which delivery to the Meico enterprise was ordered according to the orders of the Minister of Defense no. 550 dated 25.04.2007, no. 1208 dated 19.07.2007, no. 1300 dated 07.08.2007 and no. 2044 dated 07.02.2007, it turns out that the amount of ammunition ordered to be delivered is greater than the amount of ammunition categorized for dismantling (munitions with markings 2056-57; 2057/1,2; 2115-22 ordered by orders no. 1300 dated 07.08.2007 and 2044 dated 07.02.2007)
Likewise, according to the expert report, it results that for three types of ammunition it was ordered to be delivered to the Meico enterprise by order no. 1208 dated 19.07.2007, without having previously had a decision on their categorization (munitions with designations 2227; PN; 2087-96). For the delivered ammunition that has not been categorized, the new price has not been determined by the price approval commission.
The delivery of these munitions in fact, rather than those removed from use, was carried out pursuant to the order of the Minister of Defense no. 2044 dated 07.02.2007, except for only one item of ammunition (2127-28) which was delivered without any order of the Minister of Defense.
Similarly, the Minister of Defense at that time, that is Fatmir Mediu, who is currently a defendant, did not predict the costs of transporting ammunition, nor who would bear these costs. According to the expert report, the financial damage caused to the state was 59 million ALL.
"In the orders of the Minister of Defense no. 550 dated 25.04.2007, no. 1208 dated 07.2007, no. 1300 dated 07.08.2007, it appears that in no case were the costs of ammunition transportation provided and it was not determined from which the subject would bear the transport costs. Whereas with the order of the Minister of Defense no. 2044 on 07.02.2007 it was determined that the transport costs should be borne by the Meico company. In no case was it determined that the transport costs should be borne by the commercial companies SAC inc and Albademil sh.pk'
Another fact evidenced by the act of military expertise is that by order of the Minister of Defense, the delivery for sale and dismantling of large-caliber ammunition was ordered
In the act of military technical expertise, it was concluded that, with the order of the Minister of Defense no. 2044 dated 07.02.2007, the delivery to the Meico company for sale and dismantling of ammunition of calibers 100 mm to 152 n was ordered, which are ammunition of a caliber larger than 70 mm, which are considered as large caliber ammunition, in excess of VKM no. 138 dated 14.03.2007, chapter IV, point (1), in which the sale for disassembly of ammunition is provided only for types of small caliber ammunition. The quantities and types of large-caliber ammunition submitted for dismantling are reflected in the expert report in a separate table.
Likewise, according to the act of technical expertise provided by Shqiptarja.com, the ammunition warehouses in Gërdec should have been licensed as ammunition depots (warehouses), before the amount of ammunition and their by-products were stored in them, where from all the documentation it appears that they were not any licensing of ammunition depots has been done.
